Additional District Judge Colombo Chamath Madanayake on Friday, rejecting the position taken by the Attorney General that Namal Rajapaksa MP had no provision under the statutes to seek compensation from the officers of the Financial Crimes Investigation Division (FCID), allowed the petition filed by Rajapaksa seeking Rs. 200 million compensation from the OIC of the FCID and two of its officers to proceed with the case and fixed the date of hearing for July 12.
Rajapaksa has, in his petition, said that it was unlawful for the FCID to take him into custody without conducting investigations and keep him in remand custody on a false charge.
Rajapksa was charged with accepting Rs. 70 million from the Indian Company Kris Lanka Ltd for developing rugby in the country. He was arrested on July 11, 2016 and released on July 18, 2016 on an order given by the Colombo Fort Magistrate.
In his petition Rajapaksa says his unlawful arrest has caused immense damage to his image and he was subjected to severe mental and physical pressure.
He has named OIC of the FCID Chief Inspector R. A .K. Premaratne and Sub Inspectors Withanage and Don Shanthalal as respondents.
