Dilan Perera Envied by Colleagues as Upeshka Swarnamalie Requests and gets Post to Monitor his Ministry.

The most envied minister in the UPFA cabinet this Sunday morning must undoubtedly be the Minister for Foreign Employment Promotion and Welfare Dilan Perera. Not only for his dashing looks and his jet black hair for a man of his age but mainly for receiving presidential benediction and special dispensation for his Badulla election flop.

It came in the form of 30-year-old Kuwait-born television actress, UPFA MP Upeksha Swarnamalie, better known as Paba after her popular screen role, charged with the presidential warrant to keep eyes focused on Dilan and his ministry and to monitor progress.

It had the ministers gritting their teeth in disbelief and undisguised envy, wondering if this was the reward for a simple failure what would be the gift for an electoral catastrophe.

Ranil Wickremesinghe Must Cast Aside Fears and Enter Presidential Race Irrespective of Victory or Defeat

Leader of the House Minister Nimal Siripala de Silva said it best when he told Parliament on Tuesday, “The Supreme Court has given an excellent judgment.”

Now with the Supreme Court’s unanimous ruling, a vehement ‘yes ‘resounded ten times round the table for added comfort, the sibilant squeaks of moribund dodos that peeped out of the deadwood to hold otherwise have been silenced; and the way has been cleared of lingering nettles, for President Mahinda Rajapaksa to contest for a third consecutive term of presidential office without any legal bar to give him the blues.

The only question left for him to ask now, and, this time, receive answer not from the Supreme Court but from the entire nation, is: “Contest against whom?”

Whilst the President has conducted his affairs impeccably and has shown himself to be a decisive man of action by voluntarily requesting the judicious hands of Supreme Court judges to lift the pall of murky doubt as to his eligibility to contest again and reveal the true landscape in legal light, there is Bedlam in the opposition camp.

Adorned in the whitest white of legitimacy’s softest fleece and sashed with the purple seal of supreme approval, the President has presented himself at the starter’s post and is already on his mark; whistle in hand, ready to blow the race to a start. As things stand in the opposition locker rooms, he might as well sound it and get the sprint over with.

So what’s the problem bedeviling Siri Kotha?

“TNA Should not Encourage External Factors Including the UN to Interfere with Sri Lanka”-Douglas Devananda

Jaffna District Parliamentarian and General Secretary of the Eelam People’s Democratic Party (EPDP), Douglas Devananda, says that he welcomed the Supreme Court determination that allowed President Mahinda Rajapaksa to contest the Presidential polls for the third time since he was the only leader to provide a dignified peace to the country where all people are treated equal.

In an interview with The Nation, he criticized the Tamil National Alliance (TNA) for indulging in selfish politics that deprived the Tamil people of their rights, and misleading them through false claims. “The TNA should realize the reality and come to terms with it. They should not encourage external factors including the UN to interfere with Sri Lanka and should try to solve issues by discussions. The Government has always been open for discussions. They should use these opportunities to discuss and solve the issues,” he said.

Can Chandrika Kumaratunga Contest Presidential Elections for a Third Time Like Mahinda Rajapaksa?

When Leader of the House, Minister Nimal Siripala de Silva, announced in Parliament on Tuesday, 11 November, the Supreme Court Opinion on the third presidential term of Mahinda Rajapaksa, the immediate reflection in the minds of many was; ‘if Mahinda can, so can Chandirka’.

The matter, however, is not so straightforward.

As the Opposition is frantically looking for a common candidate, to bring all parties in the Opposition onto a common platform to defeat President Rajapaksa, the former President too, has sought a comeback. Whether she is qualified to do so, is another matter altogether.

UNP Affiliated Eksath Bhikku Peramuna Warns Ranil of Withdrawing Support if Karu Jayasuriya is not made Presidential Candidate.

Eksath Bhikku Peramuna, affiliated to the UNP has warned that it will withdraw support for the party at the upcoming presidential election unless UNP MP Karu Jayasuriya is declared the presidential candidate.

Ven. Girambe Ananda Thera has, in a letter to UNP National Leader Ranil Wickremesinghe, insisted that it is the UNP prerogative to name the presidential candidate in accordance with the campaign spearheaded by Ven. Maduluwawe Sobitha Thera, convenor of the Movement for Just Society.

Ven. Ananda has stressed that former Deputy Leader of the UNP is the only one suitable in the party to be the Opposition common candidate.

Erik Solheim says Norway made Economic Resources Available to the LTTE Peace Secretariat with full Knowledge of Mahinda Rajapaksa.

While rejecting the allegations of supporting the Liberation Tigers of Tamil Eelam (LTTE), Norwegian peace facilitator Erik Solheim said that President Mahinda Rajapaksa was fully supportive of Norwegian peace efforts and encouraged Norway to continue and had asked Norway to keep him informed of developments.

Responding to the allegations levelled against him by President Mahinda Rajapaksa on actively funding the LTTE, Solheim stated that economic resources were only made available to the LTTE Peace Secretariat and that it was done with the full knowledge of the Government of Sri Lanka under different leaders, including President Rajapaksa.

President Rajapaksa Accuses Norway and Erik Solheim of Financing the LTTE During the War.


President Mahinda Rajapaksa has demanded that the Norwegian government must probe the funding of the LTTE during the island’s three-decade civil war, alleging that Norway financed Tamil Tigers.

“They (Norway) gave money to the LTTE. The Norwegian government must investigate. We have evidence on how they funded the terrorists,” Rajapaksa said addressing a political gathering in Kurunegala.

He specifically blamed former Norwegian minister and peace facilitator Erik Solheim for backing the LTTE.

Q:
What actually happened at that television debate? What happened behind the scene?

A: I must thank you for giving me this opportunity to talk about what happened. There was a scheme behind the incident. Our intelligence sources scented it. I was aware that my telephone conversations were being recorded. I was under surveillance. My Facebook account was hacked and information extracted.

I continued to express my views via television debates and social media. I discussed the budgets of the Head of State and extravagances of the offspring. I criticized the ministers. Although I did not complain to the Commission to Investigate Allegations of Bribery or Corruption, I had done the necessary thing. As a result, Chief Minister Dayasiri Jayasekara is seeking Rs 500 million in damages from me. Nimal Lanza is seeking a damage of Rs 1 billion. There are others too.

No Decision Taken by Mahinda Rajapaksa to Issue Presidential Pardon for Five Indian Narcotics Smugglers Sentenced to Death.

A day after Sri Lankan Deputy Minister Prabha Ganesan announced that President Mahinda Rajapaksa was ready to pardon the five Indian fishermen facing death penalty, presidential spokesperson Mohan Samaranayake on Wednesday told The Hindu: “Until now, no decision has been taken to that effect.”

Asked why Mr. Ganesan made an announcement to the contrary, sources close to the President’s office said Mr. Rajapaksa only spoke of possibly commuting the death sentence to life.

On Tuesday, an appeal was filed against the Colombo High Court’s sentence awarding death to the Indian fishermen, and three Sri Lankans, for alleged drug trafficking. In a late evening development on Tuesday, Mr. Ganesan — who met the President to offer his support in the coming elections — told the media that the President was ready to pardon the fishermen if India did not go ahead with the court appeal.

A: I totally deny the statement by Thavarsa. I don’t know what denominator he had used to arrive at the said percentage. According to our Provincial Council Budget and the Appropriation Act passed in December 2013, our total expenditure is Rs 15, 526 million.Our capital expenditure is Rs 1, 876 million. According to the progress review report by the Northern Chief Secretary,Rs 19, 481 million is the total expenditure of the NPC.

Rajnikanth,Kamal Haasan and the Influence of Actors in the Politics of Tamil Nadu.

On his 60th birthday on November 7, Tamil cinema’s ever-green actor Kamal Haasan signed up for Prime Minister Narendra Modi’s‘Swachh Bharat’ (‘clean India) campaign. With that, he also took with him, his fan-following under the ‘Kamal Haasan Narpani Mandram’ (welfare club).

It is one thing that Modi promptly tweeted Kamal’s initiative, but the actor clarified that there was ‘no political philosophy’ behind it.

A self-acknowledged non-believer, who otherwise swears by Dravidian icon, ‘Periyar’ E V Ramaswamy Naicker, Kamal obviously wanted to send out a clear message that his joining the ‘Clean India’ campaign did not mean that he approved of Modi/Bharatiya Janata Party’s ‘Hindutva’ agenda or any other.

It did not mean much in political terms as Kamal Haasan, almost since the start of the welfare club named after him, had made it clear to his fans that entering politics was not his cup of tea.

In comparison, Tamil cinema’s other ‘super-star’ Rajnikanth, often accused of using his film-releases to send out a ‘political message’ to garner additional expectation at the box-office, has stayed away from his fans and crowds on his birthday (December 12) for years now.

Ven.Rahula Thera of “Namal Uyana”Fame Advises Defence Secretary Gotabhaya Rajapaksa not to Enter Active Politics.

Politics is a disease which popularity predisposes some people to. Those who excel in their chosen fields are often asked whether they intend to take to politics. Some of them stoop so low as to go behind politicians, seeking nominations or allow themselves to be lured into partisan politics. Among them are scholars, former judges, sports personalities and various other professionals like doctors, engineers, accountants et al.

Ven. Rahula Thera of the Namal Uyana fame has recently urged Defence Secretary Gotabhaya Rajapaksa not to take to active politics. The monk is of the view that the top bureaucrat can continue to render a better service to the country while holding his current position.

Defeating terrorism is thought to be Gotabhaya’s greatest achievement. True, winning a protracted war considered ‘unwinnable’ is no mean achievement. But, he can preen himself on winning a bigger war elsewhere—on public roads. He got Sri Lankan drivers to wear seat belts, a task that many thought was impossible! He has also been instrumental in carrying out urban beautification and densification projects in the face of stiff resistance from some quarters.

President Mahinda Rajapaksa who once walked from Colombo to Kataragama calling for the abolition of the executive presidency could become another Mahasen if he only listened to reason, a constituent member of the UPFA government said yesterday.

Leader of the Jathika Hela Urumaya (JHU) Omalpe Sobitha Thera addressing a rally at Muttiah Park in Colombo, organised by the Peoples Movement for a Just Society, headed by Sobitha Thera and his very own party member and Chairman of the National Council for a Clean Tomorrow, Rathana Thera calling for an end to the executive presidency, observed that Rajapaksa was similarly placed as King Mahasen

Though Mahasen was today remembered as a great leader towards the latter stages of his rule he did a lot of wrong things and many in his inner circle including his trustworthy Minister and friend Maghavannabaya had launched a public campaign to oust him. Even as public protests gathered steam, Maghavannabaya visited the King taking along with him some of his favourite food, which prompted Mahasen to query why he was working against him and also trying to be his friend, to which Maghavannabaya replied: ” You are a great King, but of late you have been treading a wrong path. We, have no personal vengeance against you. It is our love for the country and its people that has forced us to agitate against you. The King having listened patiently apologised and changed his ways. That is why Mahasen is even today remembered as a great King.”

Confident Mahinda now Confused. Rajapaksa Regime has been Cornered by the USA Through its UNHRC Game Plan.

Two years ago everyone who visited Temple Trees or the President’s House and came out used to say, ‘Mahinda is confident’ and was focusing on the immediate challenges before him. However, within the past years those who go there to meet Mahinda say, ‘Mahinda is confused’.

Mahinda who thought that Ranil would contest him at a future Presidential Election, started a campaign against Ranil, labelling the latter as a ‘Tiger’ though such an election is yet to be announced. Then Mahinda gave up that campaign. Last week it was heard that Mahinda had congratulated Karu Jayasuriya as the Common Opposition Candidate. However, Karu had said there was no such decision taken. Now, it is learnt that the government is exploring ways to counter if Chandrika becomes the common candidate. Rumours of the return of Mangala Samaraweera to the government also spread in a confused manner. That was an indication it was difficult to capture Opposition MPs to the government though the latter boasted much in that direction.

No politician in the world would ever relinquish power on his or her own volition, unless there is something drastically imposed upon him or her by an outside force or an irreversible debilitating condition has set in the physique of him or her. Such is the addictive quality of power.

Political power is the most potent ‘aphrodisiac’ in the world, Henry Kissinger once said. It could lure a most unsuspecting damsel into lust; it could sway the strongest of men into submission and it could also turn a most vociferous opponent into the charmer’s vision.

When one gets accustomed to this sensuous workout of political power, life outside it looks uninteresting and dull. The usual Blue Label whiskey, evening cocktail parties, scrumptious banquets at Embassy-get-togethers ending up with an occasional visit to the exclusive rooms and tables in the nearest casinos are a bit too much to say adieu to. Caught up in the vicious cycle of power and glamour, politicians build an illusionary universe; a universe whose realities are as impermanent as morning dew and as fleeting as the wanton gusty winds across a barren desert.

They mistake those who crave friendships and acquaintances for life-long friends; they abandon those whose financial and social standing couldn’t keep up with the progressive rise which they themselves had accomplished.

Entwined in a web of mythical superiority of power and enrapturing sense of comfort and luxury, ruling classes, wherever they are, desperately cling on to power because that very power is infusing oxygen into their daily existence. When one describes this phenomenon of power’s lustful dynamics, another may be driven to think that those who are caught up in the web are acutely aware of this process.

13th Constitutional Amendment is Deeply Flawed but There Can be no Question of Rolling it Back

(Text of a presentation by Prof Rajiva Wijesinha M.P. at the international seminar held on November 6th and 7th 2014 on “An Appraisal of India’s Neighbourhood Policy: Way Forward“at the Maulana Abul Kalam Azad Institute of Asian Studies, Kolkata.India)

In the period leading up to the victory over the terrorist Tigers of Tamil Eeelam in 2009, India and Sri Lanka enjoyed an excellent relationship. It was clear that, despite the opposition of politicians in Tamilnadu, India was supportive of the military initiatives of the Sri Lankan government. More importantly, it assisted Sri Lanka in dealing effectively with the efforts of some Western countries to stop the Sri Lankan offensive, and then to condemn it after the military success of May 2009.

This was most obvious in Geneva, where the Indian Permanent Representative, together with his Pakistani counterpart, comprised the negotiating team that accompanied the Sri Lankan Permanent Representative, Dr Dayan Jayatilleka, into discussions with Western nations that had wanted a resolution critical of Sri Lanka.

Since then the relationship deteriorated. In 2012 India voted in favour of a resolution put forward by the United States that was strongly critical of the Sri Lankan government. And though much aid and assistance was given to Sri Lanka for reconstruction after the war, India seems to feel that this is not properly appreciated – as evinced by recent remarks by the Indian High Commissioner.

Conversely, a response to his speech in a Sri Lankan newspaper displays even great angst, culminating in the complaint that ‘In the more recent past, India repeatedly voted against Sri Lanka at the UNHRC in Geneva whereas in view of India’s domestic political constraints, all India had to do was abstain which Sri Lanka would have appreciated immensely.’ Before that there had been a catalogue of the support offered in the eighties by India to terrorist movements in India.

Survey of 520 Sri Lankan Tamil Refugee Families in India Shows 67% Dont Want to Return and 23% want to Return.

A survey by the Tata Institute of Social Sciences (TISS), Mumbai, among the one-lakh-odd Sri Lankan Tamil refugees in India has found that 67 per cent of them want to remain in India.

Only 23 per cent of the 520 families surveyed wanted to return to the island nation, while four per cent wanted to migrate to a third country where they had relations, said the TISS survey.

The study titled ‘Exploring Durable Solutions for Sri Lankan Tamil Refugees in India’ was released by Rafael Garcia, Country-Director of Adventist Development and Relief Agency, India, at the India International Centre here on Monday.

Tamil Refugees in India ready to Return Home but well-structured Repatriation Process with Tripartite MOU Needed

The overwhelming feeling among the Sri Lankan Tamil refugees in India is to return home, but the repatriation process should be well-structured with the backing of a Memorandum of Understanding among India, Tamil Nadu and Sri Lanka, according to S.C. Chandrahasan, founder, Organisation for Eelam Refugees Rehabilitation (OfERR).

Asked about Sri Lanka’s Northern Province Chief Minister C.V. Wigneswaran’s appeal to the refugees to return home, he said the Sri Lakan Tamils wanted to protect their soil and end their refugee status.

Mr. Wigneswaran, who was here on a private visit, had said the return of the refugees was important to ensure adequate representation for Tamils in Parliament and to foil the government’s design to alter the demography of traditional Tamil areas.

The Chief Minister of Sri Lanka’s Northern Province, C.V. Wigneswaran, made a strong case on Monday for the return of Sri Lankan Tamil refugees in Tamil Nadu to their homeland, saying it was necessary to prevent the government’s “design” to settle the Sinhalese in the traditional Tamil areas.

Addressing a press conference here along with his Health Minister P. Sathyalingam and TNA MP M.A. Sumanthiran, he said that over 1.2 lakh Tamil refugees from Sri Lanka were living in India, and their presence back home was necessary to ensure Tamil representation in parliament.

He said most of the refugees had left behind their land and property in Sri Lanka. If they continued to live in India, their property would be appropriated by the Sri Lankan Army. “They will settle Sinhalese in the traditional Tamil areas, and it will change the demographic pattern of the Northern Province,” he said.

Northern Chief Minister Wigneswaran wants India to Reverse on Going Militarisation of Tamil Majority Regions in Sri Lanka.

Chief Minister of Sri Lanka’s Northern Province C.V. Wigneswaran on Sunday made a fervent appeal to India to prevail upon his country to reverse the ongoing militarisation of the Tamil-majority region and stop what he called harassment and abuse of minorities there.

Mr. Wigneswaran, on his first visit since being elected, alleged that militarisation was taking place “not due to any real security threat, but to maintain a stranglehold over the populace; subjugate them and make them compliant; and to stifle any form of democratic or political dissent.”

Delivering the K.G. Kannabiran Memorial Lecture, organised by the People’s Union for Civil Liberties (PUCL) here, Mr. Wigneswaran, a former judge of Sri Lanka’s Supreme Court, said that in the last few weeks, the government was arresting and openly intimidating those trying to collect evidence for an U.N.-backed investigation into violations of human rights.

Speaker Chamal Rajapaksa has called for a clarification from Secretary to the Ministry of Defence and Urban Development Gotabhaya Rajapaksa as regards a statement attributed to Indian Defenec Minister regarding India acquiring weapons from Sri Lanka.

The statement has been made in the Lok Sabha.

The Speaker was responding to a query raised by UNP Ratnapura District MP Thalatha Atukorale and listed on the Order Paper for the fourth time yesterday.

MP Atukorale asked whether the statement attributed to Indian Minister of Defence was true and if so the time period in which the transaction had taken place, the types of weapons, funds received from India and any documentary proof that would ensure the transparency of that transaction.

Leader of the UNP Ranil Wickremesinghe while urging the European Union Council to appeal against last month’s decision by its General Court to lift the ban on the LTTE imposed on May 29,2006, yesterday expressed regret that President Mahinda Rajapaksa had still not taken any steps in that regard.

“I will also take up this matter with the Ministry of Foreign Affairs, Netherlands and the Foreign and Commonwealth Office, United Kingdom,” Wickremesinghe said adding that Rajapaksa was mollycoddling the LTTE, with an eye on the next presidential election.

Wickremesinghe observed that the President had failed to challenge the LTTE’s appeal against its proscription by the European Union (EU) Council and was disinterested in contesting the ban on the LTTE being overturned, even though nearly one month had lapsed.

“President Rajapaksa’s conduct has clearly indicated who is in toe with the Tigers. The LTTE was bribed at the 2005 presidential election. Otherwise, I would have been elected President. For the last ten years Mahinda has been unfairly accusing me of being a traitor, but it is he who is in touch with the LTTE.

When I went to London last month to meet members of the UNP UK branch, the government accused me of meeting the Tamil diaspora. I challenge the President to reveal as to whom he had met during his recent visits to the US and Europe without levelling baseless allegations against me.”

“I have a Problem when Ex-LTTE Eastern Commander “Col”Karuna Talks about Human Rights Violations and Killings”.

Sri Lanka Deputy Minister Vinayagamurthi Muralitharan, known as Karuna Amman in his earlier incarnation as LTTE commander of Batticaloa, accused the Indian Peace Keeping Force (IPKF) of rape and killings during its war against the LTTE in Sri Lanka between 1987 and 90.

Speaking in Parliament on November 4, he said the IPKF had raped several Tamil women and also killed Tamils and “there is evidence for that.”

Of course, as a parliament member Karuna has every right to draw attention to human rights violations, though it was made 26 years too late.

In a democracy, human rights violations committed by any person including the army, police or anyone including political parties is totally unacceptable and cannot be condoned. They have to be inquired into. Human rights watchdogs have been created for this purpose.

“The Phantom of the Opera”Produced by Jerome de Silva is the Greatest Show I have seen at the Lionel Wendt Theatre”.

Jerome de Silva is manifestly the brains, brawn and high-voltage energy behind this production of the world famous The Phantom of the Opera, I was invited to see on 10th of October. In the 1970s Jerome’s haunting voice impinging on my consciousness through radio mesmerized me long before I met in the flesh the phantom to which that voice belonged.

When we finally met, I discovered that we had both been Josephians, albeit at different periods. Fortunately for theatre in Sri Lanka, Jerome had defected to St. Peter’s College, Colombo to put the finishing touches to his secondary school education. St. Peter’s had inspired in Jerome a passion for the theatre which is what has made him tick in maturity.

In 1992 a group of Peterites founded the Workshop Players’ Organization—the WSP Family – a nonprofit outfit dedicated to theatre. Having indulged their passion for musical theatre as best they could in a third world artistic environment for over two decades, they have climaxed with an unbelievable production of The Phantom of the Opera.

Greatest Show

I roundly declare that it is the greatest show I have ever seen at the Lionel Wendt Theatre. I hasten to add that the appellation “greatest show” applies unreservedly to the technological and stagecraft aspects of the production I saw. It was spectacular and magnificent. It was beautiful, a joy to behold. Given my innocence about the artistic intricacies of the musical genre of opera, I would be a fraud to pretend that I am equipped to judge the quality of the singing which is the quintessence of classical opera.

Because, however, I sense that I have some music in myself and that I am “moved with concord of sweet sounds” I feel that I am entitled to hazard an opinion for what it is worth. It seemed to me that the singing of all the players was pitch-perfect, impeccably phrased, melodious and harmonious. They were all emotionally convincing.

For a wrong reason I single out for special praise Sean Amarasekara who played Phantom. The reason is that Sean is, even like me, a medic with a passion for music. When I first heard him sing as a mere boy I told his mom Dr. Suriyakanthi Amarasekara the superb anaesthesiologist, and a favourite erstwhile pupil of mine, that her son had been born for opera singing and not for commercial “doctoring” (in the literal sense).

His scintillating performance as Phantom provided proof, if further proof were needed, that his natural place is the musical theatre and not the operating theatre. Moreover, Sean satisfied my vanity by amply vindicating my prophetic judgment about his singing potential. Sean was extraordinary, but not exceptional. He was ably supported by the other players of the WSP family to make the performance of The Phantom of the Opera an unforgettable musical experience. A couple of friends who had seen The Phantom in London told me that by this production at the Lionel Wendt Jerome de Silva had wrought a miracle on a third world stage.

The Future

Let us face it: in our country opera of The Phantom variety is very much an elitist musical indulgence. The excellent publication produced by the WSP to mark the production served to educate me on many aspects of the opera. One thing I gathered was that the current production of The Phantom cost “millions” and that the production was made possible mainly by the phenomenal generosity of Cargills (Ceylon) PLC. I will concede that not all accumulators of lucre are as ugly as sin. And the Gospel according to St. Luke says that “everyone to whom much is given, from him much will be required.” Cargills (Ceylon) has certainly fulfilled this biblical requirement. The challenge for the WSP Family now is how to make The Phantom accessible to many more theatre – goers with a taste for serious musical theatre. Given Jerome de Silva’s amiability, accessibility and ability “to move with kings nor lose the common touch” I think that he is the wizard best equipped to attempt the impossible enterprise.

The famous Harvard economist John Kenneth Galbraith judged that without State support arts in a capitalist society cannot flourish. This is surely true of our own country. The WSP Family has dedicated groups involved in Sinhala Theatre production. One remembers that Jerome played a critical role in the acclaimed Sinhala film called Akasa Kusum. He freely lends the fruits of his knowledge and experience in the field of drama to less privileged theatre people in our country. His choreography for the Sinhala production of Dharmasiri Bandaranayake’s The Trojan Women won the award for the best choreography in the Stage Drama Festival in 2000.

The philosophy of the WSP Family is admirable: promoting peace through drama. As it happens, the theme of The Phantom is humane: how those with short frames, bald heads and pot-bellies (even like me!) through no fault of theirs have to be made acceptable to society. In this opera, the first time Phantom with his deformed face receives a kiss from a woman, (on his forehead) the experience overwhelms him with emotion. After that humane encounter, Phantom became kinder and more tolerant. That experience mellowed him. In the end the function of art is moral. Let us hope that Jerome de Silva will be resourceful enough to bring this theatrical experience to a much wider audience.

security concerns are not limited to the PLA N submarine’s visit to Colombo only, but to the larger issue of Sri Lanka becoming China strategic ally and partner in China’s strategic power projection in the Indian Ocean Region

India expressed “serious concern to India’s national security” to Sri Lanka Defence Secretary Gotabaya Rajapaksa when he met the Defence Minister Arun Jaitley and the National Security Advisor Ajit Doval at New Delhi on October 20, 2014 over the docking of a Chinese submarine “Great Wall No.329” in Colombo harbour along with the support ship “Changxing Island” from September 7 to 14, 2014.[i] The wrong identification of the diesel-electric Song class submarine as a nuclear-propelled submarine (SSN) sensationalised the first reports on the incident adding to public concern in India.

The two Chinese naval ships were docked in the Colombo International Container Terminals (CICT) in which China has invested $500 million, indicating the possibility of China using its commercial infrastructure assets in Sri Lanka for military purposes.

After the Defence Secretary’s visit, Sri Lanka Naval Chief Vice Admiral Jayantha Perera also visited New Delhi at the invitation of his Indian counterpart Admiral RK Dhowan apparently to discuss the same issue. Talking to the media Admiral Perara allayed India’s fears on increasing Chinese military presence in the island nation. He said “We will never compromise on national security of India. India’s security is our security.”[ii]

Admiral Perera also downplayed the worry about China making any strategic inroads into the Indian Ocean Region (IOR). “They are coming normally for operational goodwill visit….For your information there is no Chinese military presence….the interest is very commercial,” he added.

But even after all this, yet another Chinese submarine – this time a nuclear-propelled one – “Changzheng-2” along with a PLA Navy (PLAN) escort warship “Chang Xing Dao” docked in Colombo on November 6, 2014.[iii]

If you insult Ravana, you are insulting me,” declared M. Karunanidhi at a recent book-release function in Chennai. For the state organiser of the Hindu Munnani, Ramagopalan, who is always wide awake to find an anti-Hindu in Karunanidhi, this remark simply meant that Karunanidhi had not changed over the years.

What irked Ramagopalan equally was the attempt by the cadres of the Periyar Dravidar Kazhagam, not many days ago, to set aflame effigies of Rama in protest against Ram Lila celebrations in the north.

Karunanidhi has, of course, changed, perhaps not enough. Despite placating devotees of Rama both local ones like Ramagopalan and those holding power in Indraprastha like Advaniji – so as to save his government from Article 356, his romance with Ravana is enduring.

Noted scholar and Jawaharlal Nehru University (JNU) Professor M.S.S. Pandian, considered an authority on the Dravidian movement in Tamil Nadu, died on 10th November 14, following a cardiac arrest. Pandian, 57, died at the All India Institute of Medical Sciences (AIIMS) in New Delhi, where he was rushed following a cardiac arrest. He is survived by his wife S. Anandhi and a daughter.

For those of us who were taught by him, MSS Pandian left an indelible mark, and his sudden death is hard to process.

Eminent Social Scientist and Leading Authority on the Dravidian Movement, Prof. MSS Pandian Passes Away.

M.S.S. Pandian, an eminent social scientist who wrote extensively on the Dravidian Movement, south Indian politics, cinema, caste, identity and several other socially relevant issues, passed away after a sudden heart attack here on Monday.

Prof. Pandian, 53, was moved from his residence at the Jawaharlal Nehru University to the All India Institute of Medical Sciences where he was declared dead. He is survived by wife and daughter.

He was serving in the School of Social Sciences’ Centre for Historical Studies and his sudden death has put the entire department in shock.

“He was a very good guide and although I was not his direct student, he helped me a lot whenever I asked him to,” said Ambedkar, a student at the SSS.

Complaints Without European Language Translations of Supportive Documents in Tamil and Sinhala for Sri Lanka Probe Rejectd by UN

The Office of the UN High Commissioner for Human Rights (OHCHR) has rejected submissions as regards accountability issues in Sri Lanka on the basis the complainants couldn’t provide English, French, Spanish or Russian translations of all supporting documents.

Petitions and Inquiries Section of the OHCHR has ruled that those wanting to lodge complaints should meet three main conditions including translated documents.

A senior government official told The Island that the OHCHR hadn’t demanded supporting documents to be in English, French, Spanish or Russian when it called for submissions in accordance with a UNHRC resolution adopted in late last March.

It’s not a nickname; it’s not a surname, middle name or even a first name. It’s a unique phenomenon that takes a film you became famous with, or a character you played, adds it to your name and lo and behold — you get a totally different name. It’s the process by which Villupuram Chinnaiah Mandrayar Ganesha Murthy becomes Sivaji Ganesan.

It is this new name that I call the nom du film or simply the film name phenomenon that’s fairly unique to the Tamil film industry. We see something similar only in the world of American sports or gangsters perhaps — Tiger Woods and Magic Johnson; Scarface Capone or Bugsy Malone come to mind.

There’s a logic to these names. They could be based on physical attributes like ‘Gundu’ Karuppaiah or Kalyanam, ‘Semia’ Mani, ‘Kulla’ Mani and ‘Omakuchi’ Narasimhan. Smitha supposedly had skin as smooth as silk and became ‘Silk’ Smitha. It could be based on the actor’s ability — thus, Mani’s talent for quick repartee got him the moniker ‘Counter’ Mani, which was soon corrupted to ‘Gounder’ Mani and then ‘Gounda’ Mani.

We are gathered here today to remember one of India’s greatest human rights’ leaders and jurist – the late Mr.K.G.Kannabiran. He was the President of your People’s Union for Civil Liberties (PUCL) from the year 1994 to 2008. His period of office saw PUCL climbing to great heights as a human rights’ organisation. He was, I am told, deeply humble and humane as a person, passionately and intensely committed to protecting democracy and human rights, not just in India but across the globe. He was absolutely fearless in opposing the stifling of freedom and crushing of dissent.

The Republic of Sri Lanka established by the 1970 Constituent Assembly is based on two legal instruments. Firstly, the Constitution of the Republic of Sri Lanka enacted by this Constituent Assembly; Article 12 (1) of this 1972 Constitution reiterated the validity of Ceylon Independence Act 1947 passed by the UK Parliament. Secondly, the Republic of Sri Lanka Act 1972 enacted by the UK Parliament with the consent of the Government of Sri Lanka. This Act amended the Ceylon Independence Act 1947 by substituting “Sri Lanka” for “Ceylon”. Under the provisions of this Act:

Sec. 1 (1) No Act of Parliament of UK passed on or after the appointed day shall extend or deemed to extend to Sri Lanka as a part of the law of Sri Lanka, unless it is expressly declared that Sri Lanka has requested and consented to the enactment thereof.

(2) From the appointed day, His Majesty’s Government in the United Kingdom shall have no responsibility for the Government of Sri Lanka.

First Schedule

No law and no provision of any law made after the appointed day by the Parliament of Sri Lanka shall be void on the grounds that it is repugnant to the law of England.

Thus the establishment of the Republic was given legal validity by our former colonial masters, the UK Parliament, by enacting the Republic of Sri Lanka Act 1972.

President Rajapaksa will be Re-elected this time Because of the Impression and Impact he has made and has on the Nation’s Consciousness.

I suppose it takes the Sri Lankan Opposition to make the slogan of a common candidate, a source of fissure and the search for unity a source of division. But that’s Sri Lanka, or rather, that’s the Sri Lankan Opposition. It would be fun to have good old CBK as common candidate though I doubt that even the Sri Lankan Opposition is going to do something that corny. CBK would be an entertaining, hard hitting public speaker on a broad opposition platform. As candidate though, she’d be able to achieve something really difficult: poll far fewer votes than even Ranil Wickremesinghe. Not many could match that, unless you count the good Rev Sobitha. CBK is that out of sync with the zeitgeist.

Chandrika can peel off some SLFP MPs but she cannot break the SLFP voters away from Mahinda Rajapaksa. She may have a few barons but not the SLFP serfs, who are accustomed to loyally serving whichever ‘royal’ family runs the party. In any case, the SLFP grassroots actually like and respect Mahinda Rajapaksa much more than they do the deposed queen.

President Rajapaksa will be re-elected this time, despite economic disaffection and even if the entire electoral process were to be freely observed by, say, the Commonwealth, because of the factor of ideological and cultural hegemony (to use Gramscian terminology), i.e. the impression and impact he has made and has on the nation’s consciousness.

Sunday, November 9 marks the 25th anniversary of the fall of the Berlin Wall. This event heralded the end of the German Democratic Republic (GDR—East Germany), forty years after it was founded.

The anniversary celebrations planned in Berlin are extensive. Some 8,000 glowing balloons marking the route of the wall will rise into the sky at 7 in the evening to the sounds of Beethoven’s “Ode to Joy.” Elderly pop stars such as Udo Lindenberg and Peter Gabriel, joined by the Berlin Staatskapelle under Daniel Barenboim, will give a concert at the Brandenburg Gate.

The regional broadcaster RBB is devoting an entire day to the fall of the Wall. A press release states that the programming on the anniversary “seeks to revive the endless joy of 1989 and make palpable the craziness of the time.”

German President Joachim Gauck already attended an October 9 ceremony in Leipzig on the topic “Twenty Five Years of Peaceful Revolution.” There, he compared the protests against the East German regime 25 years ago with the great revolutions of the 18th Century in America and France and “the German freedom movement of 1848.”

“Tens of thousands overcame their fear of the oppressors because their desire for freedom was greater than their fear,” proclaimed Gauck. “What was started by a few brave individuals became a movement of the masses that grew inexorably into a peaceful revolution.”

The Rise of Mikhail Gorbachev and the Fall of the Berlin Wall.


THE fall of the Berlin Wall was not big news in Russia. Neither was it a surprise. It was a logical consequence of the process that began in Moscow in 1985 when Mikhail Gorbachev came to power.

By 1989 his perestroika, or reconstruction and opening, was in full swing. Andrei Sakharov, Russia’s most famous dissident and nuclear scientist, returned from his forced exile in Gorky and was elected to the first Soviet parliament. Banned films and books flooded the intellectual space. The physical space also opened up, as Russians started to travel to the West.

The idea of sending tanks to stem velvet revolutions in Eastern Europe was unthinkable. Mr Gorbachev told Communist leaders in Eastern Europe that Moscow would not interfere in their domestic affairs as early as 1985. The leaders did not believe him, or did not want to share the news with their people—for once Soviet soldiers and subsidies were removed, their own days would be numbered.

Nearly 100 Youths in Kerala Hug and Kiss in Public as “Kiss of Love”Campaign Protesting Against Hindutva Group Moral Policing

It seemed the protest would end without so much as a public hug but, the “kiss of love” campaigners surprised everyone with a display of affection leaving behind some iconic images of a new daring.

They were outnumbered, subjected to vituperative attacks online and offline and their leaders put under preventive arrest, but the small group of youngsters who took upon themselves the daunting task of interrogating the deeply entrenched intolerance towards any public display of affection, pulled off an unlikely victory on November 2.

Amid heckling by ultraconservative sections of the Hindu and Muslim right and harassment by the police, nearly 100 youngsters hugged and kissed in public at the Marine Drive in Kochi to declare to the whole world that they are here to challenge moral fascism and moral policing.

“Is Sri Lanka About to give a Naval Base to China?”

An explanation often is worse than the presumed offence. Statements from Colombo and Beijing this week on the frequent appearance of Chinese submarines and ships at Sri Lankan Ports are likely to worsen New Delhi’s concerns rather than blunt them. Both Colombo and Beijing have countered India’s concerns by stating that there is nothing unusual about Chinese naval visits to Lankan Ports.

“It is an international common practice for a navy submarine to stop for refuelling and crew refreshment at an overseas port,” an official from China’s Defence Ministry told China’s news agency Xinhua. A Sri Lankan Navy Spokesperson did acknowledge the Chinese vessels’ arrival at the Colombo Port last week. He said “a submarine and a warship have docked at Colombo harbour” and added that this is “nothing unusual”. “Since 2010, 230 warships have called at Colombo Port from various countries on goodwill visits and for refuelling and crew refreshment,” the spokesman said.

The latest developments in Tamil Politics are causing great anxiety to the people. The TNA and more particularly the ITAK is running at a tangent without knowing where they are taking the Tamil people who are in the dark. The time has now come to let them know the true history of the Tamil United Liberation Front, the only strong formation left behind by great Tamil Leaders like S .J. V. Chelvanagam, G. G. Ponnambalam, S. Thondaman, A. Amirthalingam, M. Sivasithambara, S. R. Kanaganayagam and very many such others like lawyers, academics, principals, teachers etc., as the only custodian of the Tamil cause.

Mrs. Amirthalingam, the most rightful person to talk about Mr. Amirthalingam, in her statement has very clearly stated: “History was created in Tamil Politics in 1972 when the two main Tamil Political Parties the ITAK and All Ceylon Tamil Congress formed the TULF whereby the entire Tamil community had been United.” She has further said: “My husband preserved the registration of the Federal Party for the sole purpose that no undesirable elements could misuse its symbol and the name. He never wanted to revive the Federal Party.”

Mrs. Mangayarkarasi has further said, “It is a pity that some of those groomed by him have attempted to misuse the name of the Federal Party and are trying to revive it. They have only breached the trust he had placed on them”. In conclusion she says. “Thus I categorically make it clear to all that I have neither approved nor blessed the revival of the Federal Party but instead condemn it as this act is a ploy to destroy the TULF which was formed by our great leaders.”

Narendra Modi and Mahinda Rajapaksa Discuss Issue of Five Indian Narcotics Smugglers Given Death Sentence by Sri Lankan Court.

Prime Minister Narendra Modi and Sri Lankan President Mahinda Rajapaksa on Sunday discussed possible options regarding the five Indian fishermen who were recently sentenced to death by a Sri Lankan Court.

Sources in the Sri Lankan President’s office confirmed that Mr. Rajapaksa telephoned Mr. Modi and the two leaders discussed a range of issues including the fishermen’s sentence.

While local media reports here on Monday said the fishermen may be transferred to an Indian prison, official sources in the President’s office told The Hindu that a final decision was yet to be taken.

Eminent Jurist and Human Rights Crusader V.R. Krishna Iyer Celebrates 100th Birthday by Cutting Cake.

Ailments could not dampen the spirit of former Supreme Court judge V.R. Krishna Iyer as he joined his well-wishers to cut a cake here on Saturday on the occasion of his 100 birthday celebrations.

People from various walks of life recalled Mr. Iyer’s multi-faceted roles as an eminent jurist, legislator, and a human rights crusader, at the event organised by the People’s Council for Social Justice (PCSJ) at T.D.M. Hall.

Even though Mr. Iyer did not deliver a speech owing to his health conditions, he thanked all the people for their continuing love, care and affection.

Ranil Steps Down as Presidential Candidate in Desperate bid to Prevent “Estranged” Mangala Samaraweera from Crossing Over to Govt

Mangala Samaraweera, a former Foreign Minister in the Rajapaksa administration and now a Vice President of the United National Party (UNP) is to decide soon, possibly in a week, whether he should join the UPFA Government or continue to remain in the opposition party. He has already held talks with both sides, including the UPFA hierarchy with which some important issues have been resolved but a few still remain. He has also had talks with the UNP leadership including Ranil Wickremesinghe, the national leader. He was to explain reasons that prompted him to quit the UNP. He is under heavy pressure, however, not to leave.

Samaraweera’s threat to quit has jolted the UNP leadership and prompted it to shift course. Wickremesinghe, who was the acknowledged presidential candidate, was willing to step down, according to former Chairman and close friend Malik Samarawickrema. This is to pave the way for a candidate from a ‘common front’ of opposition political parties.

Thus such a “common candidate” may come forward under a symbol which is not the UNP’s Elephant. Moves by a UNP parliamentarian to urge Deputy Leader Sajith Premadasa to come forward as presidential candidate have been spurned by the Hambantota District MP. There are increasing prospects of former President Chandrika Bandaranaike Kumaratunga being the “common candidate” though some UNP lawyers opine she faces legal impediments. The next alterative centres on Karu Jayasuriya, a former Deputy Leader and current chairman of the UNP’s Leadership Council, but Wickremesinghe, fears it might break the party.

After a two-year stint as Minister of Foreign Affairs in the Rajapaksa Government (2005 to 2007), Mangala Samaraweera was ousted from that portfolio. However, he was allowed to retain the portfolio of Shipping and Aviation. He was then embroiled in many an issue and once refused to sign a Cabinet Paper to resuscitate the loss making Mihin Air. He was also opposed to the construction of a port in Hambantota. His undoing was a 13-page letter he wrote to President Rajapaksa expressing concerns over the threats of human rights violations Sri Lanka faced. He was then sacked.

Samaraweera remained in an “advocacy” group that called itself the Sri Lanka Freedom Party (M) and contested the 2010 parliamentary elections on the United National Party (UNP) ticket. He was invited by Wickremesinghe to join the party in August 2010. There, he became the Vice President. Later he was named the Director of Communications and was thus responsible for the party’s media strategies. In that capacity he was ex officio member of the Working Committee and the Leadership Council. From an office in the basement of Siri Kotha, he directed the party’s media strategy.

“Nightmare of the Nightclubs”-Hewa Koparage Malaka Manjith Silva the son of UPFA Govt Minister Mervyn Silva

With the continuous unruly behaviour of Hewa Koparage Malaka Manojith Silva, the son of Public Relations and Public Affairs Minister Mervyn Silva, nightclub owners in the city say they fear that there would be a decline in foreign and local arrivals to their clubs since last week brawl at Rhythm and Blues night club involved with two British citizens.

The club owners queried whether Malaka can enter a night club since there was a court ruling prohibiting Malaka from entering night clubs as he became a bane to the industry and said that it would certainly affect their expected revenue of the upcoming festive season. Therefore they urged the Government to take stern action against those who are involved in shattering the peaceful atmosphere in night clubs irrespective of their affiliation to the Government. The club owners and those who are in the leisure industry asked to introduce new laws prohibiting ministerial brats that accompany groups of political goons in the guise of guests from entering night clubs intimidating and harassing patrons for ‘pleasure’.

They are aghast witnessing the antics of one particular individual whose father, the Public Relations and Public Affairs Minister, who appears not to control his son’s unbecoming conduct but rather overlooks his misdemeanours and provides him with personal and Ministerial Security at the expense of the persons he attacks — the taxpayers.

Some night club owners did not wish to comment on the issue but said that if such incidents are allowed to go unchecked it would certainly impact negatively on the tourist industry as most of their customers are foreigners.

Has Mahinda Rajapaksa Placed his Future in the hands of an Eleven Member Supreme Court Under Chief Justice Mohan Peiris?

With President Mahinda Rajapaksa invoking the jurisdiction of the Supreme Court on Tuesday to submit an opinion as to his eligibility to contest the presidential election for a third time and the Government announcing on Wednesday that it will be issuing after the 19th of November, the proclamation to hold the next presidential election, how fares the political landscape this Sunday morn as parties gear up for the good fight?

At the favoured corner of the ring, flitting like a butterfly and prancing to sting like a bee is the Lankan President Mahinda the Invincible Rajapaksa, twice hands down winner of two consecutive heavy weight champion bouts, sparring for yet another repeat performance. On the form card, he is unbeatable, and the odds are heavily weighted in his favour as are the bets. With a string of second league wins in the provinces this year under his belt, the only question seems to be ‘winner by how many rounds’?

Though none expects a win with a flooring knockout punch like he delivered in the last championship four years ago – some even question whether he will have to use every punch in the book and fight it out to the end with the match being won on points or even whether it will have to be restaged – the serious money seems to be on him, at least for the moment. Who cares even if he has to go the whole nine yards, says his cheerleaders, once won, the winner takes the crown; and that’s all that matters and, like Miss World, will wear it for the rest of its tenure, which, in his case, will be for another six years.

Govt wants to Advance Date of Presidential Election to Jan 2nd Due to Jan 13-15 Scheduled Visit by Pope Francis.


A delegation from the Vatican was briefed in detail last Monday on arrangements currently under way for Pope Francis’ scheduled visit. External Affairs Minister G.L. Peiris who chaired the meeting spelt out the different measures that were being taken. Defence Secretary Gotabaya Rajapaksa, armed forces commanders and several officials were present at the meeting.

The three-member delegation from the Vatican arrived in Colombo last Saturday to take part in this conference. Two of them who were in the front rows of the discussion were Alberto Gasbarri, Chief Organiser of Pope’s International Travel, Secretariat of State of the Vatican, and Paolo Corvini, Senior Protocol Officer, Secretariat for Relations with States, Ministry of Foreign Affairs of the Vatican.

Reality we face Today is that Sri Lanka is a Constitutionally Rogue State and not a Constitutional Democracy

There is considerable confusion prevalent in Sri Lanka’s urban circles. At one level, the Bar Association of Sri Lanka is confused as to how (reportedly) an in camera sitting of the Supreme Court was held to consider the Reference by President Mahinda Rajapaksa on his ability to contest a third term under the 18th Amendment to the Constitution even whilst the Registrar had called for Written Submissions by the Bar on the matter, this week.

Nothing to be surprised at

As the Bar expressed its surprise at this apparently cavalier treatment, it plaintively pointed out that it represents 14,000 attorneys-at-law and as such, deserved to be heard at an oral hearing on a constitutional matter of vital importance.

Yet, there is really nothing very much to be surprised at. This is a Government which flippantly disposed of its own Chief Justice in 2013 as ruffians danced outside her official residence. The continuation of such practices under the Rajapaksa Presidency is to be expected. Indeed, astonishment would be called for only if this Government had deigned to give the barest of nods to constitutional law, practice and convention in such matters.

Muslim Congress Demand for Muslim Majority Administrative District in Amparai is not a Demand for a “Muslim Eelam”.

With the resolution passed by the Sri Lanka Muslim Congress (SLMC) asking for a separate administrative district for the Muslims in Ampara, many directed accusations at the SLMC stating that it is an attempt to create a Muslim Eelam. Denying such allegations, the SLMC insists that they do not look for a separate state for Muslims but their proposal was only to create a separate administrative district for the Muslims in Ampara as Muslim majority in the area is facing difficulties having to deal with Sinhala administration in the Ampara district.

The general Secretary of the SLMC, Hasan Ali reiterated that the Muslims are not asking for a separate state as portrayed by some politicians and local media. “In 1961 they curved out the southern part of Batticaloa and extracted some area from Moneragala and made it a separate district called Amparai.

They made the administrative capital in Amparai,” he added. According to him, the administrative capital is set in an area where the Sinhala minority lives, whereas the majority of the Ampara district is Tamil speaking Muslims who live mostly close to the coastal area in Kalmunai. He explained that earlier the administrative capital was in Kalmunai as 90 % of people in the Ampara district live in coastal areas.

Did Minister Mervyn Silva’s son Malaka Violate Court Order Forbidding him from Entering any Nightclub?

According to the police Malaka Silva had been denied bail and was transferred from a private hospital to General Hospital last week and he would be produced again for an identification parade on the 18th of this month. While this is not the first time Malaka has been involved in such incidents, according to his father minister Mervyn Silva his behaviour is nothing out of the ordinary and not something that should be taken seriously.

According to the police spokesman SSP Ajith Rohana what happened that day at the night club was all recorded on CCTV cameras and had been taken by the police as evidence. Speaking to The Sunday Leader SSP Rohana said that Scotsman James Casserly is an engineer attached to a construction company and has been working in Sri Lanka for about a year. His girlfriend Belinda Mackenzie had arrived in Sri Lanka on October 29 to celebrate James’s birthday and they had visited the R&B night club that night for Halloween.

Rohana Wijeweera was Hero to Some and Villain to Many in the Political Landscape of Post-Independence Sri Lanka.

Twenty-five years ago a man was killed. He was one of some 60,000 who had been killed in those gruesome days of the late eighties. It is reported that he had been tortured and shot. It is reported that he was still alive when he was tossed into the incinerator at the General Cemetery, Borella. This was at the tail end of the second insurrection launched by the Janatha Vimukthi Peramuna (JVP).

By this time, most of the key leaders had been eliminated. The rank and file was decimated along with hundred of suspected supporters. It was a time of abduction and torture, proxy arrests and trigger-happy vigilante groups, assassination of political figures, academics and journalists, and summary execution. It was a time of courage and foolhardiness; a time when acts of terrorism by self-styled ‘revolutionaries’ was met by acts of terrorism by the State. It was a time of anarchy which effectively ended with that particular murder.

Rohana Wijeweera, hero for some and villain for many, left a signature on the political landscape of post-independence Sri Lanka. There is the fact of masterminding two (failed) insurrectionary assaults on the state. The JVP, as Dr Gamini Samaranayake has argued, also demonstrated that armed insurrection was an option and that the state was not ready. It’s a lesson that no one learned better than the LTTE. A lesson that was never learned was this: the state, over time, corrects for deficiency and prevails unless there’s a mass uprising that complements or there is pernicious outside intervention by forces far superior. The last ‘combine’ does not deliver revolution but further subjugation (e.g. Arab Spring).

Minister of Public Relations Mervyn Silva’s son, Malaka Silva is in custody once again as a result of trying to flex his muscles at a night club. Malaka who has become a nuisance in Night Clubs had in his recent jaunt caused mayhem at Rhythm and Bloom a.k.a. ‘R&B’ Night Club on the Duplication Road, Colombo.

Night Clubs have their own culture. Anyone who wants to enter a night club must buy a ticket. Various types of beautiful women are ready and waiting to welcome you into the club. They entice you to purchase good liquor and some expensive brands that go with the association of another woman.

Dance floors are open for you to dance to the throbbing of DJ controlled music.

Malaka Silva brazenly intrudes into these night clubs together with the security staff of his father, which include the officials of Ministerial Security Division, as well as private security staff that behave like underworld goons. He eats and drinks at these night clubs, but does not pay a dime, as night club sources reveal.

Colombo night club sources further said that the women shy away from the night clubs when Malaka Silva visits them.

Ranil Wickremesinghe has a mind of his own and is not Easily Manipulated by Others.

The present controversy within the UNP over the choice of a presidential candidate is not what one would expect given the electoral gains they made so recently. Less than eight weeks ago, the UNP was riding high in the wake of the Uva Provincial Council elections. They had got no less than 40% of the votes in the province and actually won the Badulla, Hali Ela and Welimada electorates and come within a hair’s breadth of winning the Uva-Paranagama and Bandarawela electorates as well.

This was the best showing that the UNP had been able to put up at any election since 2005 and it undoubtedly gave the government the fright of their lives. This result, combined with the reports of the burning of opposition ‘election offices’ in the Moneragala district had conveyed the impression to the country that the government was fighting a desperate rear guard action to retain the Uva province.

The burning of those structures of polythene and sticks that appear by the roadside at election time by pro-government thugs trying to curry favour with the Rajapaksa family conveyed the impression to the rest of the country that the government was compelled to resort to thuggery to retain their hold over Uva. So all in all the Uva PC election ended with the government appearing weakened and the UNP more upbeat that it had been in over a decade. Of course once people began to realize that Badulla is a very pro-UNP district and that since 1994, the UNP had always won in the Badulla district while losing in the rest of the country, that mood may have dissipated to some extent.

Despite this, after the Uva elections, the UNP was ideally poised to go on the offensive and consolidate their position further in the country making good use of the confusion and disarray in the government ranks. The fact that doing badly or losing in the Badulla district does not mean losing in the rest of the country offered little consolation to members of the UPFA. They had so got used to percentages over 55 to 60% at elections after 2005 that getting only 51% at the Uva PC elections appeared to them like a defeat, not a victory. Telling them that 51% was a luxury even for J.R.Jayewardene, R.Premadasa and Chandrika Kumaratunga would have been no consolation because what they had come to take for granted over the past several years was something much more!

The Tamil National Alliance wishes to respond to the statement issued by the Ministry of External Affairs appearing in the Island newspaper of 6th November 2014.

The Tamil National Alliance reiterates firmly its denial of any involvement with the individuals referred to in the said statement pertaining to the investigation being conducted by the High Commissioner for Human Rights. The Tamil National Alliance specifically states that it has nothing whatever to do with the said individuals pertaining to the said investigation or otherwise. It is ludicrous that the Government in support of such purported involvement seeks to rely allegedly upon photographs taken at public functions on public occasions.

The statement of the Ministry of External Affairs is indicative of the depth of the desperation to which the establishment has sunk.

It is extremely regrettable that a News Release should have been issued on this matter attributed personally to you questioning the integrity of the Government of a sovereign nation which has been a member of the United Nations since 1955. As you would be aware, Sri Lanka has contributed consistently to the United Nations system in numerous capacities by taking a lead in norm setting processes including the Law of the Sea Conference, disarmament and human rights.

It is unfortunate that your News Release has been issued without making any attempt to understand the context or content apparent from the Media Release of the Ministry of External Affairs dated 5th November 2014.

UN Human Rights Chief Zeid condemns persistent disinformation designed to discredit UN investigation on Sri Lanka

GENEVA (7 November 2014)UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein on Friday criticized the continuing attacks by the Sri Lankan Government on the integrity of the UN Human Rights Office’s ongoing investigation into alleged grave human rights violations and abuses in Sri Lanka, and condemned the intimidation of human rights defenders and individuals who may wish to cooperate with the investigation.

TNA Linked “Sun Master”Wanted by Police for Alleged Involvement in Conspiracy to Fabricate Evidene for UN Probe on Sri Lanka Escapes to India via negombo.

The Tamil National Alliance (TNA) Organiser for Vavuniya, Alva Pulle Vijendrakumar alias Sun Master wanted by police in connection with the ongoing investigation into an alleged plot to furnish false information to UN war crimes investigation team has escaped to India.

Well informed sources alleged that Vijendrakumar had left Negombo in a boat on Thursday.

The police and intelligence services have been looking for him in the wake of a person by the name of Sinnathamby Krishnarasa being arrested on Oct. 25 with 25 blank UN war crimes complaint forms. Of the 25 forms, six had been signed by individuals affected by eelam war IV, sources said, adding that Krishnarasa claimed that he received the UN forms from Vijendrakumar on Oct 22 at 3 pm at the Vavuniya bus stand.

Indian Prime Minister Narendra Modi Uses “Buddhist Diplomacy”to Woo South, South-east and East asia.

A definite shift in India’s Look East Policy is underway with added emphasis on Buddha diplomacy under the new dispensation. Prime Minister Narendra Modi plans to market the Buddha card to the countries in the region as India is the place of origin of Dhamma and Sangha. He indicated such a change in emphasis by his first official visit abroad to a neighbouring Buddhist country Asia, Bhutan, and then to Nepal, where Buddha was born. His first official visit outside South Asia was to another Buddhist country, Japan.

Chinese President Xi Jinping on his visit to India in September landed in Ahmedabad, Gujarat, where Prime Minister Modi received him and narrated the importance of the state in the Buddhist era and the visit of the ancient Chinese traveller Xuanzang (Hsüan-tsang) in 7th century AD. The Prime Minister of Vietnam, Nguyen Tan Dung, on a visit to India on October 27-28, made offerings at the Bodhgaya temple on his arrival.

The emphasis in the policy is likely to become more evident when the Prime Minister visits Nay Pyi Taw in Myanmar for the India-ASEAN Summit and East Asia Summit slated in the second week of December. Further edge to the new Look East Policy will be given when he visits Brisbane for the G20 Summit and have bilateral meetings with the Australian Prime Minister Tony Abbott in the middle of next month. Thereafter, Mr Modi gets the chance of expressing his Neighbours First Policy at the SAARC Summit in Kathmandu (November 26-27).

Supreme Court Registrar Blocks Bar Association Lawyers from Filing Motions on Issue of President Rajapaksa Contesting for a Third Term.

Attempts by lawyers to file motions in the Supreme Court contending that President Mahinda Rajapaksa was not eligible to seek a third term had been thwarted by the Registrar, the Bar Association of Sri Lanka (BASL) said yesterday.

President of the BASL, Upul Jayasuriya, addressing a hurriedly-summoned press conference at his association’s auditorium in Hulftsdorp, said the reason that had been given for not accepting the motions was that the hearing on the reference by President Rajapaksa seeking a determination whether he was eligible for re-election had been concluded. “I can’t believe this. What is the hurry to set a deadline for written submissions being made by 3 pm today? Beside, written submissions are filed at the end of an oral hearing.

The President’s reference to the Supreme Court was made only on Nov. 5 and yesterday was a Poya Day. A presidential election has not even been announced. Surely, a two-week time period could have been granted.”

“Action may be Taken Against Maskeliya Plantation Ltd if Necessary for Failure to Evacuate Estate Worker Families”-Disaster Management Minister

Estate companies which fail to provide alternative housing for people in landslide prone areas will be taken over by the Government, asserted Minister of Disaster Management Mahinda Amaraweera, pointing out that the majority of estate companies have not provided ‘suitable’ land and as a result people have refused to leave the areas despite impending dangers.
The Minister further pointed out that people have confirmed only half of Koslanda Meeriyabedda residents were provided with alternate housing despite warnings issued in 2005 and 2011.

Following are excerpts from an interview with the Daily FT:


Q: What are the latest developments with regard to the Koslanda landslide?

A: We are compelled to halt rescue operations from time to time due to bad weather conditions. The NBRO has warned of another possible landslide. Considering these factors, we are unable to carry out rescue operations efficiently. However, we have not completely stopped rescue work. Meanwhile, relief operations are being carried out successfully. The Government has taken every possible measure to take care of the affected people, especially the children. Although certain people try to point fingers at the Government claiming we have failed to handle the situation properly, I think it was handled very well.

Q: What is the official death toll? How many people are missing?

A: According to the Disaster Management Centre, 12 dead bodies have been recovered. The total number of missing persons was 44 as of Wednesday (5).

Prof.GL Peiris Reveals Details of Alleged Conspiracy Involving TNA Associates to Fabricate “Eyewitness Reports”for the UN Probe on Sri Lanka.


(TEXT OF MEDIA STATEMENT ISSUED BY THE MINISTRY OF EXTERNAL AFFAIRS)

The Minister of External Affairs, Professor G. L. Peiris on Tuesday, 4th November, met the Heads of Mission and Representatives of the main proponents of the Investigation on Sri Lanka by the Office of the High Commissioner for Human Rights (OHCHR) and the High Commissioner of Australia. The Deputy Country Director of the UNDP also participated representing the UN system.

Minister Peiris explained to these representatives, the details regarding the recent arrest of Sinnathamby Krishnarasa, a non-rehabilitated LTTE cadre. This action led to the discovery in his possession of blank forms containing signatures of persons affected by the conflict.

The Minister revealed how questioning Krishnarasa had led to the disclosure that he had been employed by Alva Pulle Vijendrakumar alias Sun Master, a close associate of the TNA, to obtain signatures of those affected by the conflict on blank forms on the assurance that this exercise was for obtaining monetary compensation from the UN. He had also received instructions from Sun Master to collect death certificates and National Identity Card details of persons who had lost their lives during the last phase of the conflict and personal data of war widows and photographs of disabled persons.

Sixty. Does it seem like a milestone that forces you to look back at the journey you’ve taken?

Well, it’s definitely no surprise that I am turning 60. The fact that I’ve lived this long is not really an achievement. Time passes, we age… it’s natural. This is why it annoys me when a person watches a movie and tells me that it was ‘time pass’. Would time not have passed if he hadn’t watched the film? But yes, I do throw glances at what I’ve done; I take stock of my inventory, so to speak. I think I’ve managed to retain my honesty, and while I don’t agree that it’s a great policy as the adage goes, I believe that it’s a luxury that only few people can afford.

Supreme Court if Sensible Should Refuse to Deliver Hasty Opinion on Whether President Rajapaksa Can Seek a Further Term.

It is reported in the media that President Rajapaksa has referred to the Supreme Court for its opinion the question of his own competency to contest a further term, and that the Registrar of the Court, on the instructions of the Chief Justice, has written to the President of the Bar Association of Sri Lanka inviting submissions in writing but denying an opportunity to make oral arguments in Court. Furthermore, submissions are required to be submitted to Court no later than 3.00 pm on 7 November, which gives anyone less than 48 hours to do so. It appears that the Court is required to give its opinion to the President on 10 November 2014.

It is evident that President Rajapaksa has made this reference purportedly acting under Article 129 (1) of the Constitution, which provides for the Court to exercise it consultative jurisdiction. A president, acting under this provision, may refer ‘a question’ (not any question) ‘which is of such a nature and of such public importance that it is expedient to obtain the opinion of the Supreme Court upon it’.

There is a lot of controversy about the so-called common candidate to contest the forthcoming Presidential Elections against the incumbent Mahinda Rajapaksa. The unsaid theory is that Ranil Wickremesinghe, by virtue of being the Leader of the United National Party (UNP), is the automatic choice. Ranil Wickremesinghe does not seem to have any friends or acquaintances in a traditional sense.

He has either loyalists or enemies. No moderate person who thinks rationally and calmly seems to like him. Such moderates basically want a winner; they want a trustworthy leader; a leader who shows poise and political acumen of the highest caliber to lead them away from the approaching abyss. And Ranil has not helped himself either. Each time when things seem to go right, he makes the most ill-advised public utterances or the most ill-timed trips abroad.

Ajit Doval Told Gotabhaya Rajapaksa “Chinese Submarine Presence Unacceptable to India” but Colombo Defied New Delhi by Allowing “Changzheng-2” Nuclear Sub to Dock.

NEW DELHI, November 4: The docking of the Chinese nuclear-powered submarine Changzheng 2 at the Colombo port since Sunday is sparking “enormous concerns” within the Indian Government about the intentions of Sri Lankan President Mahinda Rajapaksa, a media report said today.

Sri Lanka allowed the docking despite India’s National Security Adviser (NSA) Ajit Doval’s warning to Lankan Defence Secretary Gotabaya Rajapaksa during the latter’s recent visit here that any presence of a Chinese submarine in Sri Lanka will be unacceptable to India.

Navy Chief Jayantha Perera Denies Sri Lanka is Causing Concern to India by Aligning with China.

Navy Commander Vice Admiral Jayantha Perera yesterday stressed that the government of Sri Lanka (GoSL) would not cause hostilities among countries.

Such a course of action would be inimical to all countries including Sri Lanka, VA Perera said in an exclusive interview with The Island. “There is absolutely no need for Sri Lanka to pursue a strategy hostile to India or any other country,” he said.

The navy chief was responding to allegations that GoSL had aligned itself with the People’s Republic of China by accommodating nuclear-powered Chinese submarines at the port of Colombo in spite of India’s serious concerns.

Chief Justice Mohan Peiris Seeks Written Submissions on Whether President Rajapaksa can Contest for a Third Time.

The Supreme Court yesterday sought written submissions from legal experts on the Constitutional validity of President Mahinda Rajapaksa contesting another term and calling for an early election.

The move follows the President seeking the opinion of the Supreme Court on if he can run for the office of president for the third term as well as if there is any impediment to him calling for an election four years into his second six-year term.

The Registrar of the Supreme Court M.M. Jayasekera wrote to the President of the Bar Association of Sri Lanka (BASL) yesterday stating that Chief Justice Mohan Peiris PC has requested written submissions in respect of two questions upon a reference by President Rajapaksa.

TNA has Categorically Stated they are for a United Sri Lanka and are not Espousing a Separate State.

I came across the following statement in an article by Prof. G.H Peiris , titled “A Comment on the campaign to abolish the Presidential System”, appearing in the island newspaper dated October 24, 2014. While arguing against the abolishing of the Presidential system G. H Peiris concludes his piece with the following statement, “with a TNA leadership now more or less committed to a resumption of the secessionist campaign , there is every possibility that the regime change would lead the country into total chaos, probably featured civil war ,which of course would pave the way for the NATO to get into its democratization act in a partitioned island of Sri Lanka.”

I am not sure whether the writer is aware that the TNA leadership in general and the leader of the TNA in particular Mr. R. Sampanthan have in Parliament and outside, and in their Manifesto categorically stated that they are for a United Sri Lanka, and are not espousing a separate state. What the TNA is asking for is that the Constitution of Sri Lanka of which the 13th Amendment is a part, should be fully implemented. This would mean that not only the northern and eastern provinces but all the provinces of the country likewise, will have some say in the administration of their local areas without over centralization at every level.

This is scarcely a scary scenario, given the limited powers contained in the 13th Amendment under which the Governor of the province has substantial powers and the financial powers of the Councils are very restricted. If however the system is administered in a fair manner in accordance with the constitutional provisions ,and without the Centre interfering in or undermining it, there could be some measure of devolution, which I have no doubt the people of all communities would welcome.

With TNA Committed to Resuming Secessionist Campaign “regime Change”may lead Country to total Chaos

This comment is being written with the objective of highlighting certain considerations that have not received adequate attention in the ongoing campaign for abolishing the Executive Presidency in Sri Lanka. Participants of this campaign including certain writers whose views receive well-deserved respect often tend to overlook the circumstances that culminated in the promulgation of a new constitution in 1978 the main innovative element of which was the introduction of a system of government headed by an executive president elected directly on the basis of an all-island poll.

There was at that time extraordinarily widespread acceptance of the case for an executive presidential system in Sri Lanka – the opposition to the reform being largely confined to the stalwarts of the ‘old left’ who had been routed at the polls in 1977. The most persuasive arguments in support of the reform converged on the theme of rampant abuses under the earlier ‘Prime Minister-Cabinet’ system constitutionally founded on a ‘first past the post’ system of elections to the legislature. People who do not have excessively short memories on such abuses – for example, the establishment of government monopoly over the mainstream media; the two-year extension of the tenure of parliament employing its two-thirds majority; attempted “legalised murder” (this was the phrase used by oft cited Colvin R de Silva whose condemnation, however, had no impact) through retroactive legislation; the sledgehammer retaliation to the insurrection of 1971 which entailed, among other atrocities, innumerable extrajudicial executions; the Criminal Justice Commissions that violated all civilised norms of ‘admissible evidence’; political interferences in judicial appointments; excessive political control of public administration; the proliferation of ‘statutory corporations’ that had a debilitating impact on financial accountability in public affairs; the rejection of the principle of academic autonomy in university governance – are likely to recall that the malpractices were by no means outcomes of the establishment of an executive presidency.

Muslim Congress Demand for Muslim Majority Unit in Eastern Province is like LTTE Demand for Separate State in North-East.

The Sri Lanka Muslim Congress (SLMC) demand for a Muslim-majority administrative unit in the Eastern Province was very much similar to the LTTE’s demand for a separate state in the Northern and Eastern Provinces of Sri Lanka, Parliament was told yesterday.

The SLMC is a constituent of the SLFP-led UPFA though it contested the last parliamentary polls on the UNP ticket.

“This is a dangerous trend in politics. All of us must oppose the SLMC’s move. The government has the wherewithal to act against such projects,” UNP Colombo District MP Wijeyadasa Rajapakshe said.

Will Sri Lanka Alienate Asian Friends like South Korea and Japan due to Accomodating Chinese Submarines?

Mahinda Rajapaksa built up a close friendship with South Korea when he was the Prime Minister in 2004. Former South Korean Foreign Minister and incumbent Secretary General of the United Nations, Ban Ki-moon, who arrived to provide aid to Sri Lanka in 2004 during the tsunami tragedy went to inspect the damages caused by the tidal waves accompanied by Mahinda, who was the then Prime Minister.

During that visit, Mahinda assured Ban Ki-moon that he would convince President Chandrika Kumaratunga to withdraw Sri Lanka’s nominee for the United Nations Secretary General contest, to which, Ban Ki-moon was an aspirant. Later, on the instructions of former Foreign Minister Lakshman Kadirgamar, President Kumaratunga withdrew Sri Lanka’s nominee to contest that post.

Low profile

Mahinda became the President in 2005 and he did not alter the decision taken by his predecessor, Chandrika. Hence, Sri Lanka was rewarded with aid and job opportunities for Sri Lankans in South Korea. During the final phase of the LTTE war, Ban Ki-moon maintained a low profile and several human rights bodies charged the UN Secretary General of extending indirect support to Mahinda. The relations between Sri Lanka and South Korea were firm as concrete. However, with the arrival of some Chinese submarines to Colombo, this relationship seems to be visibly shaken. South Korea appears to be confused over that development.

Due to the unruly behaviour of Government members, the House was suspended for five minutes by Deputy Chairman of Committees UPFA MP Chandrakumar Murugesu.

Controversial “Kaththi” film Starring Vijay and the Politics in Tamil Nadu Over the Sri Lankan Tamil Issue.

Here the lines between actors and politicians blur and disengage at will. Actors enjoy the patronage of the ruling party so long as they appear to be endorsing its fortunes. When they play truant, which isn’t uncommon, they find their films blocked or blacked out from theatres.

Comedian Vadivelu, a fan favourite, was sent to the doghouse after campaigning for the DMK, which lost to J. Jayalalithaa’s AIADMK. After a two-year exile, he only recently surfaced seven months ago with a comedy film.

Vijay, a Kollywood superstar, has flirted with politics and has realised that as with everything else, there is a price to pay despite the halo of stardom and, no, you cannot please everyone.

Now the Sri Lankan Tamil issue is a highly emotional one—actors and directors have discovered that much to their peril (and often close to the date of their film’s release). Invariably, the call for withdrawal happens a day before the release. The Vijay-starrer Kaththi (The Knife) is no exception.

“Northern Chief Minister is Crying for more Powers and Money Without Utilizing what he already has”-NPC Opposition Leader.

The Northern Provincial Council Opposition Leader and EPDP member S. Thavarasa claims for police and land powers in the province should amicably settled. “We must create a situation where the majority should feel that by giving these powers, it will not be misused. There is suspicion in the majority that those powers could be misused”, he pointed out. Thavarasa represents the EPDP headed by Minister Douglas Devananda who is a UPFA ally. A fortnight ago Thavarasa travelled to Colombo to address the media at the Government Information Department.

Following are excerpts of the interview:

Q:
The Central Government allocated funds for the development of the Northern Province. But you say that the Northern Provincial Council (NPC) has not done any development activities. So tell us now what have they done with the money?

A: Normally the government does not give money but they allocate funds. During Budget 2014 the government allocated Rs. 5831 million for the NPC as capital expenditure. This would be the highest allocation when compared with other provinces. All other provinces got much lesser allocations than the Northern Province.

When allocations are provided they must carry out development projects, ask for the money and pay it. Either the money may come from the NPC or the government may pay directly. So far, up to 30 September the progress of the Provincial Council has been 25.17%. They have completed nine months since they secure the NPC.

Catholic Church Denies that President Rajapaksa had Demanded Cancellation of Visit by Pope Francis to Sri Lanka.

In spite of the UNP on behalf of the Opposition urging the government to conduct the presidential election after the scheduled papal visit, the Catholic Church is strongly opposed to such a move.

The Catholic church was of the opinion that a national level election shouldn’t be held immediately after the proposed papal visit to ensure the Holy Father’s visit wasn’t exploited by any political party.

Rev. Father Cyril Gamini Fernando told The Island yesterday that the government had been apprised of their position. Rev. Father Fernando said that the Church had always asserted that a national level election shouldn’t be held in the immediate aftermath of a papal visit.

Journalism is the world’s best profession. I believed that when I first became a trainee sub-editor in 1981.

I believed that when, after more than 20 years as a journalist in Mumbai, Dubai, and Bangalore, I was given a golden opportunity to give back to the profession as a journalism teacher at a media college in India’s Silicon Valley.

And I believe that even today as I revel in the joys of journalism when sharing my experiences with my students, year after glorious year.

Of course, I am not the first person to assert that journalism is the best job in the world. The credit for that goes to the late Gabriel Garcia Marquez, whose essay on the subject has been shared and re-shared multiple times on the Internet.

Media Secy and Police Spokesman Blame Mainstream Media for Faulty Coverage of Koslanda Landslide Tragedy.

Media Secretary Charitha Herath yesterday cited recent media coverage of the Koslanda landslide tragedy as a glaring example of inadequacy on the part of both print and electronic media.

Herath alleged a section of the media had been in such an inordinate hurry that unsubstantiated casualty figures were given wide publicity.

Responding to a query by The Island, Herath asserted that in spite of having the state-of-the-art equipment, the media hadn’t enhanced its capacity to verify facts.

Herath said that within hours of last Wednesday’s tragedy, the media had placed the number of men, women and children missing at over 300. Within five days, police headquarters brought the number of missing down to 38.

Estate Tamils of Indian Origin have long been the victims of the antipathy of successive governments.

A deadly landslide that swept through the Meeriyabedda tea plantation in Koslanda last week, buried an unknown number of plantation workers and their families under a mound of mud, wiping out an entire village.

About a hundred people, many of whom were estate Tamils are feared dead in the worst natural disaster to hit Sri Lanka since the 2004 tsunami. Nonetheless, the government, which habitually declares days of mourning over the passing away of aging monks and octogenarian politicians, has not thought it fit to do so for the deceased workers, who live in abject poverty. This could well be an indication of how much the lives of average citizens are worth (in this case, the most vulnerable as well) on the scale of the government’s value system.

Estate Tamils of Indian Origin have long been the victims of the antipathy of successive governments. They were demeaned by the per-independence Sinhala and Tamil political leaderships and were disenfranchised by independent Ceylon’s first Prime Minister D.S. Senanayake. Later, in 1977, J.R. Jayawardene restored the citizenship rights of a large swathe of estate Tamils.

However, pre-independence antipathy gave into a general sense of apathy for the next few decades. Estate Tamils lived segregated lives, mired in inter-generational poverty, in their hill country ghettos.

Late Prema Chandra Imbulana has the rare distinction of having served the country from village level being elected Chairman of the Village Council to a Parliamentarian, Deputy Minister, a Minister and then Governor in two Provinces of Sri Lanka, in a colourful and distinguished career in politics spanning six decades. He was also the President of the D.S. Senanayaka Memorial Society a position he held and was dedicated to until his sad demise two years ago.

I had the privilege of serving under him as the Public Relations Officer and in the capacity of Private Secretary during some of the time he was Minister and as Governor. I was no relative of his. He assigned me the task because he felt that I was capable for the job and the good working relationship we cultivated when I was a planter.

“21 Million Sri Lankans will have a Secure and Stable Future only if we Continue with Executive Presidency”-Arun Tambimuttu

The Executive Presidency is a must for Sri Lanka and it is essential for the country’s security and stability. If we have a Prime Ministerial system, the Ministers will be horse traded. This will make the country unstable and open to attack from anti Sri Lanka elements. Whether we like it or not, the Executive Presidency provides stability, efficiency and helps protect the country’s sovereignty. The Executive Presidency and the Legislature should remain separate just as it exists now. Mixing up these two will create instability. The 21 million Sri Lankans will have a secure and stable future only if we continue with the Executive Presidency. If we go back to the past, the country will be plunged back to war and destruction as was experienced before 2009. Unfortunately, Sri Lankans have very short memories. We cannot allow the country to return to the dark era, Sri Lanka Freedom Party (SLFP) Batticaloa Organizer Arun Tambimuttu told the Daily News during a recent interview.

Q: The decision of the European Court of Justice (ECJ) to annul the EU regulations proscribing the LTTE is one of the latest significant developments in connection with the security of people living all over the world, especially in the EU and in Sri Lanka. Please comment.

A: The decision of the European Court of Justice (ECJ) to annul the EU regulations proscribing the LTTE raises a number of questions. The first question is the timing of it. It was done prior to the Presidential Election in Sri Lanka and the General Election in U.K. The motive of this act is also questionable. Today there is permanent peace in Sri Lanka after more than 30 years of bloodshed. Sri Lankans suffered at the hands of the barbaric LTTE which bombed buses, trains etc., and hacked to death infants, pregnant mothers, elders and sick people. The people are now rebuilding their lives and the country is developing very fast.

But still the pro LTTE elements and anti Sri Lankan elements all over the world are very much active. A large number of European citizens of Sri Lankan origin are living in peace without fear and intimidation on the part of LTTE fund raisers, who go around collecting funds from innocent people by force. Both Sri Lankans and the people of Sri Lankan origin living in Europe will be at risk now.

I also believe that the defenders in this case, the UK Government, the Dutch Government as well as the EU had not put through a vigorous case in order to retain the ban. Therefore, the lifting of the ban is a threat to people living all over the world.

Minister Mervyn Silva’s son Malaka Remanded for Assaulting Scottish Couple James Francis and Belinda Mckenzie at “Rhythm and Blues”Nightclub.

British High Commission is inquiring into the circumstances under which a British couple had been assaulted by Public Relations Minister, Mervyn Silva’s son, Malaka and some of his associates, in the early hours of Saturday (Nov. 1) at a night club down Duplication Road.

The victims suffered injuries on their heads and faces.

Responding to a query by The Island yesterday afternoon, BHC spokesperson said that the Consular Section was handling the case though a statement couldn’t be made at the moment. She said the BHC was yet to speak with the couple.

The incident was the first involving British tourists since former Chairman of the Tangalle Pradeshiya Sabha, Sampath Vidanapathirana and three others were sentenced to 20 years rigorous imprisonment last July over the killing of British aid worker Khuram Sheikh and gang-raping of his girlfriend at a resort in Tangalle in Dec 2011.

Close to 100 Sri Lankan Citizens -most of them in Tamil Nadu-are Facing Drug Smuggling Charges Before Indian courts.

A Colombo court’s recent awarding of death sentence to five Tamil Nadu fishers, for alleged drug-smuggling in 2011, has underscored the urgent need for the Governments of India and Sri Lanka to amicably resolve the vexatious fishing issue, without further loss of time. With this verdict on Thursday, the core issue may have also moved away from livelihood concerns of fishers from both sides, to be possibly replaced by legalities of alleged illegal actions of not only fishers but also other citizens of one country in the other.

Along with the five Indians, the Colombo court had also sentenced three Sri Lankans to death for allegedly partnering with them. Indian media reports, particularly those in Tamil Nadu, are mostly silent on the matter. As coincidence would have it, a Polonnaruwa court in another part of Sri Lanka awarded death to four others for clubbing to death a fellow Sri Lankan in 1996. The convicts in both cases are entitled to appeal their conviction and sentencing.

Sri Lankan law provides death sentence for drug-related offences. Indian laws too now provide for death for ‘repeat offenders’. Even otherwise, Indian laws for drug-smuggling are harsh. At present, close to 100 Sri Lankan citizens are facing drug-smuggling charges before Indian courts, most of them in Tamil Nadu. As with the case of most domestic offenders, their cases also get delayed for a variety of reasons.

Karl Marx expanded famously on Friedrich Hegel’s remark about “history”occurring twice and stated that history repeats firstly as tragedy and secondly as farce. If a recent development in Sri Lanka runs its full course as intended, then one may very well say History repeats itself in Sri Lanka as a tragical farce or farcicial tragedy when it comes to Ranil Wickremesinghe.

With a presidential election being anticipated early next year, an atmosphere of déjà vu is in the air.The propaganda knives of the Rajapaksa regime are out already in a hasty bid to slash and draw first blood. The decision by the European Union General court to annul sanctions against the Liberation Tigers of Tamil Eelam (LTTE) on the one hand, and the visit of Ranil Wickremesinghe to Britain on the other, are being used by Govt propagandists to project an impression that the opposition leader in league with tiger elements in the Tamil Diaspora has conspired to remove the EU ban on the LTTE, thereby endangering Sri Lanka’s security, territorial integrity and sovereignty.

The propaganda that is being churned out in various forms ranging from posters to ministerial pronouncements is perhaps the opening gambit on the 2015 presidential poll chessboard. If Ranil Wickremesinghe comes forward as expected , to contest as the chief opposition UNP candidate against President Rajapaksa, more propaganda in similar vein is likely to follow.

The thrust and theme of Govt propaganda will most likely compare and contrast both candidates ,projecting the president positively and the opposition leader negatively..Mahinda will be portrayed as hero and patriot while Ranil will be depicted as traitor and anti-national.

Gotabaya Rajapaksa tells Catholic Bishops that President Rajapaksa would be Humiliated if Pope Francis Visit Does not take Place as scheduled.

The increasing certainty of the presidential poll on January 8 has raised another issue — the visit of Pope Francis. He is still scheduled to arrive on January 13 for a three-day visit. An advanced team from the Vatican arrived in Colombo yesterday to examine the ground situation and determine whether the visit should remain on schedule. Tomorrow, the team will meet External Affairs Minister G.L. Peiris during an inter-agency conference at the EAM where the advance team will learn about the arrangements being made.

The Vatican delegation will also meet the members of the Catholic Bishops Conference. The Vatican’s position on the visit was explained to UPFA leaders by the Archbishop of Colombo and head of the Catholic Bishops’ Conference His Eminence Malcolm Cardinal Ranjith. He has said that the convention was that the Pope does not visit a country that faces elections for at least one month before that event. Similarly, he also does not visit a country for a month after elections are held.

The UPFA Government is keen to ensure the Pope’s visit, currently on schedule, is not in any way changed. So much so, Defence Secretary Gotabaya Rajapaksa addressed a meeting of the Catholic Bishops’ Conference on October 24. Of the 14 Bishops representing different dioceses, two were absent. They were Jaffna’s Bishop Rt. Rev. Thomas Savundranayagam and Trincomalee’s Bishop the Rt. Rev. Kingsley Swamipillai.

UK based “Mobile Mogul” Rajah&30 Relatives Forbidden to fly on UL Flight 503 by capt.Senthoorselvan due to Drunken Misconduct.

The high-flying Rajahs who made it big in Europe post-1983 selling mobile telephones and buying influence got their just desserts when their boorish behavior came to an abrupt halt onboard SriLankan Airlines Flight 503 to London on the October 29 (last Wednesday).

The Rajahs from the UK, all 31 of them, and all of Lankan origin except for the kiddos, were on a holiday to the Four Seasons hotel in the Maldives. The cheapest room at the Four Seasons is more than US$ 1,600 (Rs. 208,000) a night. The bunch of them all arrived in Sri Lanka and proceeded to the Maldives on a SriLankan Airlines flight. Also on the same flight and at the Four Seasons was former Sri Lankan cricket captain and national selections committee chairman, Sanath Jayasuriya, MP and the national carrier’s Marketing Manager G.P. Jayaseelan. They were all having a good time, mainly at the bar.

The holiday turned sour when the party started making their way back ‘home’ in Britain.

Pseudo-Reform Hidden Agenda of Jathika Hela Urumaya and its Seven “Sham”Proposals.

The long simmering disquiet over the 1978 constitution and the need to abolish the executive presidency by amending the constitution and introducing a more democratic form of government more in accord with the aspirations of the Lankan people, have now risen to the boil.

The nation’s gong has been rung, the trumpet has been blown and the conch shells have been sounded to rally all forces to give effect to the national mood and temper to correct a 36-year constitutional folly which created an executive Head of State, enthroned with the sceptre of near dictatorial power.

But if such vast powers weren’t more than enough to rule without restraint, the UPFA government, utilising the two-thirds majority it had gained through dubious means in parliament with the support of a batch of turncoat UNP MPs, thought fit to abolish the last few remaining checks and balances on unfettered power with the introduction in 2010 of the 18th Amendment to the constitution. This amendment, brought at the zenith of a people’s euphoria over the triumphant annihilation of Tiger Chief Prabhakaran and his terrorist brigade, was manacled to the hands of the people even as they vigorously clapped the glories of victory.

Four years have now passed since the 18th Amendment and much water has flowed under the UPFA bridge, to reveal to a now sobered up populace the potential inherent in the constitution for any future President to unscrupulously utilise to further his dictatorial ambitions; to not merely keep his extra, unwarranted, unnecessary power safely locked in his vault but to wear, flaunt and exploit the unmasked power a grateful nation gifted in gratitude and trust as a thanksgiving present to President Mahinda Rajapaksa for winning the war and ushering the peace.

Of Rs Rs 5,831 Million Allocated by Govt for North,the Provincial Administration has Utilised only 25.17% up to Sep 30th 2014-Douglas Devananda.

01. Hon. Speaker, thank you for granting me this opportunity to speak in the second reading of the 10th Budget of our Government guided by “Mahinda Chintana National Vision for Development” and presented by His Excellency the President.

02. The ambitious development initiatives of the Government over the last nine years have started yielding results and this year’s budget has proven it by sharing this dividend with the people by way of variety of reliefs to all the segments of the society.

03. The economic indicators such as the economic growth of 8 percentage, the anticipated per capita income of US $ 4,000 for 2015, which is 4 times higher than what it was 10 years ago, keeping the budget deficit at 5 % of GDP and trying to further reduce it in the coming years and reduction in debt/GDP ratio, presented by His Excellency the President during the cause of His budget speech is testimony to the success of the Mahinda Chintanaya vision.

04. Drastic decline in the number of people living below the National Poverty Line i.e. from 15.7 percent to 8.7 within the last five years, rural poverty from 15.7 to 7.6, poverty in plantation sector from 32 to 10.9 percent, people with less than US $ 2 per day income from 28.3 percent to 18.9 percent, reduction in the maternal mortality rate are all indicators that the Mahinda Chintanaya vision is yielding better results.

Collapse of Beragala Mountain Triggered Flow of Mud that Engulfed Meeriyabedda Estate in Koslanda

As the clouds gathered overnight last Tuesday over the hills and a drizzle began in the pre-dawn of Wednesday (29), the country was fast asleep. No one dreamt that it would turn out to be a tragic morning for hundreds of estate sector families.

The tragedy that shook the central hills was the worst to hit Sri Lanka after Tsunami 2004. When the mountain came rolling downhill many villagers in the Koslanda-Meeriyabedda Estate in Haldummulla ran to save their lives. They said, it sounded like an explosion. The thick layer of mud flattened the dwellings and buried the people who were unable to run away.

It was 7:30 in the morning when the Beragala Mountain began to slowly crumble and cracks began to appear in several surrounding mountain slopes. Some villagers were inquisitively observing the changes appearing in the mountain slopes, but the majority were rushing to gather their belongings and run to safety as they had earlier been warned by the Haldummulla Divisional Secretariat officers.

Estate sources said cracks began to appear days before, but most of the villagers had not been in a position to evacuate. On the day of the tragedy, those who had heeded the warning and evacuated to safer areas, had returned to their line houses to collect some more of their belongings to be taken to their shelters as the heavy rain had ceased.

However, suddenly, the mountain started to slowly collapse. Mud flowed down with a crushing force.

The arrival of another Chinese submarine, Changzheng-2 and a warship, Chang Xing Dao, at the Colombo Port on Friday, has raised eyebrows in diplomatic circles with India focusing attention on its security, Ceylon Today learns.

This is the third submarine that has arrived from China this year, it has been revealed.
The submarine had arrived at the port along with warship Chang Xing Dao, which is its security escort and has docked at the Colombo harbour till 6 November.

Last week, unable to withstand the increased military ties with China, India invited Sri Lanka Navy chief, Vice Admiral Jayantha Perera to India to express their concerns.

The Navy chief, who was in New Dehli, on a five-day visit, assured that Sri Lanka will do nothing to compromise the security of its regional neighbours.

He also stressed that there was no Chinese military presence in Colombo.

Govt must Enact new Laws Immediately to Provide Estate Workers with new Lands that are safe from Landslides.

We may be standing on his child’s grave.

The heartbeat of the dead is silenced now, but the heartbeat of the living can be heard louder exposing acutely personal emotions.

Those who were killed do not hear the heartbeat of the living. The living people also do not hear the heartbeat of the dead.

They don’t want food, or water. They are weeping for the dead as if to send messages to the dead through the soil under which they are buried.

Death is not begged and it is not an offering given to beggars. But, death has become beggars’ offering in this country. It’s the wonder of Sri Lanka. The error is in Sri Lanka being a wonder. Death is the lapse of time between the last meal and the last breath. It includes a meaning that defines the meaning itself.

Why Mahinda Rajapaksa Cannot Become President Rajapaksa for a Third Term Despite Amending Constitution for 18th Time.

I have discussed in these columns some days ago the contention that President Rajapaksa is not qualified to fight an election for a third term by virtue of the operation of Article 31(2) of the Constitution. The repeal of that article by the Eighteenth Amendment does not remove the past operation of anything suffered under the repealed law.

Since ex-CJ Sarath Silva first raised this issue, lawyers and non-lawyers have tried to make the case that Sarath Silva is wrong and that President Rajapaksa is not prevented by the Constitution to seek a third term. I have pointed out, and so has Suri Ratnapala, that the relevant section of the Interpretation Ordinance to look at is section 6(3) (a).

Yet, some commentators have relied on another section of the Ordinance, namely section 6(3)(b), and have argued that it does not apply to President Rajapaksa as he has not acquired a ‘penalty’ under that section! It is an argument that suffers from the fallacy of the false premise.

For it is not section 6(3) (b) that is relied on. It is, on the contrary, section 6(3)(a) which provides that:

“Whenever any written law repeals either in whole or part a former written law, such repeal shall not, in the absence of any express provision to that effect, affect or be deemed to have affected-

(a) The past operation of or anything duly done or suffered under the repealed written law;” (emphasis added)

In this article I will deal with some of the other arguments that have been advanced to support the position that President Rajapaksa can seek a further term. I will also highlight some of the basic principles that militate against a Rajapaksa third term.

Mr. Presiding Member, I am happy to follow my good Friends, the Hon. (Dr.) Wijeyadasa Rajapakshe from the UNP and the Hon. Maithripala Sirisena, Minister of Health from the Government, both of whom are Members who are held in high respect by all sections of society in this country.

I want to commence my speech, Sir, by conveying our deepest sympathies for the national calamity that occurred at Koslanda where due to an earthslip, a large number of people have perished; a large number of people have died and people have suffered immense devastation and destruction. So, we want to convey to the people of Koslanda that we are with them at this moment of tragedy and that our feelings are with them and that we pray for them. We would urge the Government to take all necessary action to ensure that these people are provided with the necessary relief and also hope that the Government takes appropriate action to ensure that these people who live in such territories do not have to face the danger of such calamities in the future.

Govt Probes Suspected TNA activity in Providing Unsubstantiated Information to UN war Crimes Investigation on Sri Lanka

The government investigating an alleged Tamil National Alliance (TNA) plot to provide unsubstantiated information to UN war crimes investigators wants to question Vavuniya-based senior TNA official Alvapillai Vijendrakumar alias Shan Master.

Authoritative sources told The Island yesterday that the TNA official had hurriedly left his Vavuniya residence and sought refuge presumably in Colombo or its suburbs after his name transpired in the ongoing probe. Sources said that Vijendrakumar had to be questioned to verify the alleged involvement of two politicians, one of them a member of Parliament. Sources said the politicians were responsible for what they called a vilification campaign against Sri Lanka.

A senior investigator said: “The police searched Vijendrakumar’s residence consequent to the recovery of 25 blank UN war crimes complaint forms from Sinnathamby Krishnarasa, a civilian who had received LTTE training. We took Krishnarasa into custody on October 25 at Mulankavil in the Vanni. Under interrogation, the suspect claimed that he received the blank forms from Vijendrakumar on the afternoon of Oct 22 in Vavuniya.”

Only 37 Persons -not 192 – Comprising 11 men,20 women and 6 Children Missing in Landslide Disaster says Police Spokesman

The Police Spokesman yesterday contradicted the figure of 192 given by Disaster Management Centre (DMC) as the number of missing people in Wednesday’s landslide on the Ampitikanda estate, Mihiribedda. He said it was only 37 and the actual number of bodies recovered so far as three. They were a 62-year-old man, six year-old girl and a woman aged over 50 years. The former two had been identified but the latter remained unidentified, he said.

Addressing a media briefing at the Police Headquarters, SSP Ajith Rohana said many news reports had claimed that eight bodies had been recovered but the actual number of bodies found was above the mentioned figure and challenged anyone to prove if the figure was wrong.

The data had been collected from the statements by the people who were being temporarily sheltered in the two welfare camps, Grama Niladari and estate manager in that estate called Kotawatte, the SSP said.

“Police investigations are still underway but figures of missing and recovered bodies won’t be more than five” he insisted.

Proposal to Allocate safe State Lands to People Living in Landslide Prone areas to be Presented to cabinet soon.

The government had asked estate owners to take action to relocate their workers living in landslide prone terrain to safe areas but they had not heeded that directive, Disaster Management Minister Mahinda Amaraweera said yesterday. Unless they responded favourably, action would have to be taken to take over their properties to ensure workers’ safety, he warned.

A proposal to allocate state land certified by the National Building Research Organization (NBRO) as safe for people currently living in high risk landslide prone areas would be presented to the Cabinet shortly, Minister Amaraweera said.

According to the latest statistics issued by the Disaster Management Centre (DMC), only three bodies had been recovered so far and over 100 people were still reported missing from Wednesday’s catastrophic landslide at Haldamulla in Badulla District.

Around 1,067 people belonging to 320 families had been affected and the number of survivors was 183. About 66 houses and seven buildings had been completely destroyed, DMC stated.

“Govt Does not Require International Assistance to help Koslanda Landslide Victims”says Disaster Management Minister Mahinda Amaraweera

Disaster Management Minister Mahinda Amaraweera said in Parliament yesterday that there was no need for foreign assistance or aid to provide relief to victims of the Koslanda landslide as the government was capable of looking after the affected people.

Making a special statement, the minister said that there were around 1,000 persons in temporary welfare centres and foreign nations, organisations as well as local institutions had offered their assistance to provide relief for the affected people.

“There are lots of groups who may try to make use of this calamity. They may organise campaigns to collect funds and material saying that they would be for the use of affected people, but none of us know where the funds and materials so collected will end up. We request the people not to fall prey to such fraudsters,” the Minister said.

He said that the government had sufficient funds to provide necessary assistance and relief to the people who had become victims of the landslide disaster. “There is no need for international assistance. If anyone wants to provide scholarships or assistance to children affected, then such assistance should be channeled through the government agencies and transparency should be maintained.”

Colombo High Court Sentences Five Tamil Nadu and Three Sri Lankan Fishermen to Death for Smuggling Narcotics.

The Colombo High Court on Thursday awarded the death sentence to five Tamil Nadu fishermen arrested by the Sri Lankan Navy in November 2011 on drug trafficking charges.

P. Emerson, P. Augustus, R. Wilson, K. Prasath, and J. Lanklet from Rameswaram spent nearly a year in prison in Jaffna and were later taken to the Welikada prison in Colombo, said sources in the Indian consulate in Jaffna.

The fishermen were charged with smuggling heroin into northern Sri Lanka, an allegation they have strongly denied.

Three Sri Lankan fishermen were also sentenced to death on the same charges.

Charges of Money Laundering of 2 Billion Rupees Filed by Special Court Against DMK Chief Karunanidhi’s wife Dayalu,Daughter Kanimozhi and 14 others including ex-DMK minister A.rajah.

Former Telecom Minister A. Raja, MP Kanimozhi, DMK chief M. Karunanidhi’s wife Dayalu Ammal and 16 others were on Friday put on trial in a 2G scam-related case by a special court, which observed that charges of money laundering are prima facie made out against all of them.

Special CBI Judge O.P. Saini framed charges under Section 120B (criminal conspiracy) of the IPC and under the provision of the Money Laundering Act against 19 accused, including 10 individuals and nine companies, who were charge sheeted by the Enforcement Directorate (ED) in connection with the case.

“All charges are prima facie made out against each accused for laundering of money of Rs 200 crore from DB Group company to Kalaignar TV Pvt Ltd,” the judge said.

337 Persons from 57 Families in 63 Units from 06 Estate Line rooms Affected by Landslide:522 Survivors Housed in 2 Tamil Schools.

Many of the people who perished in the Koslanda landslide had continued to occupy their homes in the landslide prone area despite repeated warnings, Parliament was told yesterday.

Chief Government Whip and Water Supply and Drainage Minister Dinesh Gunawardena said the area where the disaster occurred had been identified as a landslide prone area way back in 2005.

“It was recommended in 2005 that 75 families be shifted from the place and they were provided with alternative houses and the area was declared a reserve. In 2011 the possible danger of landslides was further confirmed and 35 families were given the option to move to a safer area, according to the District Secretariat.”

However, despite the new land being given, many people had continued to occupy their old homes which were destroyed by the landslide, Minister Gunawardena said in a statement to Parliament.

Number of Persons Missing After Badulla District Landslide Disaster Brought down to 192 from 350 but no Hope of Survivors

Hopes of finding survivors in the landslide-hit village in Haldummulla in the Badulla District were fading, Disaster Management Minister Mahinda Amaraweera said yesterday.

“No survivors have been found so far and I don’t think there could be any survivors,” Minister Amaraweera told The Island after visiting the place for the second day.

“Bad weather is hampering search and clearing operations; rescuers are digging through mud”, he said, adding that there was also a risk in digging the area further as the National Building Research Organization (NBRO) has warned that the adjacent hills may collapse and some cracks on the upper crust of the land had been observed.

“We will keep rescue operations going, but under the prevailing conditions it is very, very bleak,” the Minister added.

Chief Opposition Whip John Amaratunga Blames Govt for Failing to save Lives of People Killed in Landslide Disaster.

The government could make excuses but it should accept the responsibility for its failure to save the lives of people who perished in the Koslanda disaster, Chief Opposition Whip John Amaratunga said in Parliament yesterday.

Chief Opposition Whip, addressing Parliament soon after the Chief Government Whip and Water Supply and Drainage Minister made a special statement on the scope of the disaster and the action taken by the government, said that the Opposition wished to convey sympathies to those who had lost their near and dear ones on Wednesday.

He said that it was the first time a landslide had destroyed so many lives in the known history of the country.
