{"id":62797,"date":"2019-02-03T02:12:44","date_gmt":"2019-02-03T07:12:44","guid":{"rendered":"http:\/\/dbsjeyaraj.com\/dbsj\/?p=62797"},"modified":"2019-02-03T02:13:21","modified_gmt":"2019-02-03T07:13:21","slug":"westminster-courts-chief-magistrate-revokes-arrest-warrant-against-ex-military-attache-brig-priyanka-fernando-and-adjourns-case-until-mrch-1st-to-further-discuss-immunity-issue-and-determine-whet","status":"publish","type":"post","link":"https:\/\/dbsjeyaraj.com\/dbsj\/?p=62797","title":{"rendered":"Westminster Courts Chief Magistrate Revokes Arrest Warrant Against Ex-Military Attache Brig.Priyanka Fernando and Adjourns Case  Until Mrch 1st to &#8220;Further Discuss Immunity Issue&#8221; and Determine Whether &#8221; Action Constitutes  Public Order Offence&#8221;."},"content":{"rendered":"<p><strong>By Sujeeva Nivunhella in London<\/strong><\/p>\n<p>Chief Magistrate of Westminster Magistrate\u2019s Court, Emma Arbuthnot tendered an apology for the \u2018administrative mishandling\u2019 of former Sri Lankan military attache, Brigadier Priyanka Fernando\u2019s public order offence case, when hearing resumed on Friday.<\/p>\n<p>She has revoked the previous arrest warrant saying that she did not know how such a sensitive case went to trial without it &#8220;ever coming across to my desk&#8221;.<\/p>\n<p><!--more--><\/p>\n<p>When the arrest warrant was issued at the last hearing, Foreign Secretary Ravinatha Aryasinghe met with the British High Commissioner in Colombo and referred to the Vienna Convention on diplomatic immunity, which resulted in the Foreign &#038; Commonwealth Office giving a certificate to Court explaining Fernando\u2019s diplomatic status.<\/p>\n<p>The Chief Magistrate adjourned the case till March 1, 2019, to \u2018further discuss the immunity issue\u2019. The Court will also determine whether the action of Brigadier Fernando would constitute a Public Order Offence.<\/p>\n<p>The private prosecution against Fernando was initiated by Majuran Sathananthan and four others after the military attache made a cut-throat gesture at Tamil protesters, who demonstrated opposite the Sri Lanka High Commission in London during last year\u2019s Independence Day celebrations.
