{"id":61653,"date":"2018-11-13T19:29:01","date_gmt":"2018-11-13T23:29:01","guid":{"rendered":"http:\/\/dbsjeyaraj.com\/dbsj\/?p=61653"},"modified":"2018-11-13T19:29:01","modified_gmt":"2018-11-13T23:29:01","slug":"attorney-general-jayantha-jayasuriya-tells-supreme-court-the-executive-presidency-is-in-force-now-and-that-the-president-could-exercise-his-executive-powers-to-proroguedissolve-or-summon-parliament","status":"publish","type":"post","link":"https:\/\/dbsjeyaraj.com\/dbsj\/?p=61653","title":{"rendered":"Attorney -General Jayantha Jayasuriya Tells Supreme Court the Executive Presidency is in Force now and That  the President Could Exercise his Executive Powers to Prorogue,Dissolve or Summon Parliament"},"content":{"rendered":"<p><strong>By Chitra Weerarathne<\/strong><\/p>\n<p>The Supreme Court yesterday issued an interim order suspending, till Dec. 07, President Maithripala Sirisena\u2019s gazette notification dissolving Parliament and calling a general electioni and granted leave to proceed with all the fundamental rights violation petitions filed against the recent dissolution of Parliament.<\/p>\n<p>At the outset Attorney General, Jayantha Jayasuriya President\u2019s Counsel told the Supreme Court that Article 33\/2\/C of the Constitution empowered the President to exercise his executive powers, to prorogue, dissolve or summon Parliament and Article 70\/1, explained the procedure he was bound to follow, in dissolving Parliament and fixing the dates for the nomination and the election.<\/p>\n<p>The incumbent President had followed the constitutional provisions in dissolving the Parliament and fixing a date for the election, the AG\u2008maintained. The aforesaid provisions had been endorsed even after the introduction of the 19th Amendment to the Constitution.<\/p>\n<p>Article 62(2) of the Constitution empowered the President to dissolve Parliament.<\/p>\n<p><!--more--><\/p>\n<p>In the 1978 Constitution, the executive presidency was introduced instead of a ceremonial one.<\/p>\n<p>At present the executive presidency was in effect.<\/p>\n<p>The Attorney General had been made the respondent in the twelve fundamental rights violation petitions filed in the Supreme Court, challenging the recent dissolution of the parliament by the President.<\/p>\n<p>AG Jayasuriya, PC appeared with Additional Solicitor General Dappula de Livera, PC, Additional Solicitor General Indika Demuni de Silva, PC and Deputy Solicitor General Nerin Pulle.<\/p>\n<p>The Attorney General requested the Court to dismiss the petitions as baseless.<\/p>\n<p>Seventeen intervention petitions were filed. Some supported the petitions while the others, opposed the petitions and said that the President had the power to dissolve Parliament.<\/p>\n<p>Prof. G. L.
