{"id":34786,"date":"2014-11-09T01:08:03","date_gmt":"2014-11-09T06:08:03","guid":{"rendered":"http:\/\/dbsjeyaraj.com\/dbsj\/?p=34786"},"modified":"2014-11-09T01:10:33","modified_gmt":"2014-11-09T06:10:33","slug":"nightmare-of-the-nightclubs-hewa-koparage-malaka-manjith-silva-the-son-of-upfa-govt-minister-mervyn-silva","status":"publish","type":"post","link":"https:\/\/dbsjeyaraj.com\/dbsj\/?p=34786","title":{"rendered":"&#8220;Nightmare of the Nightclubs&#8221;-Hewa Koparage Malaka Manjith Silva the son of UPFA Govt Minister Mervyn Silva"},"content":{"rendered":"<p><strong>By <\/p>\n<p>Nirmala Kannangara<\/strong><\/p>\n<p>With the continuous unruly behaviour of Hewa Koparage Malaka Manojith Silva, the son of Public Relations and Public Affairs Minister Mervyn Silva, nightclub owners in the city say they fear that there would be a decline in foreign and local arrivals to their clubs since last week brawl at Rhythm and Blues night club involved with two British citizens.<\/p>\n<p>The club owners queried whether Malaka can enter a night club since there was a court ruling prohibiting Malaka from entering night clubs as he became a bane to the industry and said that it would certainly affect their expected revenue of the upcoming festive season. Therefore they urged the Government to take stern action against those who are involved in shattering the peaceful atmosphere in night clubs irrespective of their affiliation to the Government. The club owners and those who are in the leisure industry asked to introduce new laws prohibiting ministerial brats that accompany groups of political goons in the guise of guests from entering night clubs intimidating and harassing patrons for \u2018pleasure\u2019.<\/p>\n<p>They are aghast witnessing the antics of one particular individual whose father, the Public Relations and Public Affairs Minister, who appears not to control his son\u2019s unbecoming conduct but rather overlooks his misdemeanours and provides him with personal and Ministerial Security at the expense of the persons he attacks \u2014 the taxpayers.<\/p>\n<p>Some night club owners did not wish to comment on the issue but said that if such incidents are allowed to go unchecked it would certainly impact negatively on the tourist industry as most of their customers are foreigners.<\/p>\n<p><!--more--><\/p>\n<p>\u201cThis is not the first time this particular group of goons disrupted the peace in night clubs ably supported by their personal and Ministerial security who get into the fray irrespective of the fact that the victim did not start the fracas in the first place.<\/p>\n<p>\u201cWe are against this thug entering our premises but we are not in a position to say it openly as we fear the repercussions. All our guests have to tolerate him; otherwise every table would be turned upside down by his supportive back up security. For how long can we ignore such unruly behaviour and for how long can our guests continue to suffer in silence? Security provided by the Government is given to junior Silva and even his father will not spare us if we go public with what he has done over the years,\u201d said one club owner who did not wish to be named.<\/p>\n<p><strong>The incident<\/strong><\/p>\n<p>Embracing the hideous lifestyle that comes with too much money and too little guidance, these are the products of a bad up-bringing coupled with sleazy living that thrives in a musky world of thuggery, sex and drugs.<\/p>\n<p>The pleasant ambience of the Rhythm and Blues night club has been rudely shattered by the rowdy presence of Malaka, his body guards and his coterie of friends on Friday October 31. The CCTV footages which is now with the police show, Belinda Mackenzie, the girl friend of James Casserly, who arrived in the country two days before the incident, is kicking unruly Malaka although both were on the dancing floor a few minutes earlier. Since it is alleged that Malaka was trying to be funny with Belinda, he was kicked. It was then James assaulted Malaka on his nose where the bridge of the nose is said to have broken. Belinda and James have received head injuries from the assaults of Malaka\u2019s security guards.<\/p>\n<p>When this newspaper contacted James Casserly to find out what exactly happened on that the day, James said that he cannot make any comment on the issue as he was instructed by the British High Commission in Colombo not to talk to the media on the matter.<\/p>\n<p>\u201cSoon after the incident I told what happened to me and Belinda to one local English daily paper. After the news was published the British High Commission wanted me not to make any comments to the media. Sorry I cannot talk to you in this regard,\u201d James said.<\/p>\n<p>When asked whether it is true that he is planning to withdraw the police complaint he has lodged, James refused to make any comment.<\/p>\n<p>According to information James is reported to be in fear for his life. It is further said that neither James nor Belinda has left home after the incident. Reportedly Belinda has been harassed by a man who is supposed to be Malaka and when tried to protect Belinda, more than seven men had come and assaulted James but surprisingly no one who were in the club at that moment has come forward for the British couple\u2019s assistance.<\/p>\n<p>The report further states that the couple has not gone to a hospital in fear of their lives and as a result of the assault on James head, he (James) is suffering from blurred vision.<br \/>\n<em><br \/>\n************************************<\/em><\/p>\n<p><strong><br \/>\nMalaka\u2019s and other ministerial brats\u2019 track records<\/strong><\/p>\n<p>Malaka and two of his bodyguards on November 2, 2006 pleaded guilty to attacking Police Narcotics Bureau (PNB) officers who were on a drug raid at a night club in a five star hotel.<\/p>\n<p>Colombo High Court Judge Upali Abeyratne ordered each of them to pay compensation of Rs. 10,000 and enter into a bond in Rs 100,000 to be of good behaviour for one year. The accused were Malaka and his bodyguards Sampath Kumara Rajapakse and Prasanna Kumara Suresh.<\/p>\n<p>The judge ordered that the compensation be directed to the Police Rewards Fund.<\/p>\n<p>In a direct indictment by the Attorney General the three accused were charged with willfully causing hurt to deter a public servant from his duty. Malaka was charged with intimidating and obstructing the PNB team which went on a narcotics raid with a court order to the night club My Kind of Place at Taj Samudra in the early hours of July 24, 2005.<\/p>\n<p>The accused were indicted with assaulting police personnel including PC R.W. A. Dayan Lasantha \u2013 an offence punishable under Section 323 of the Penal Code.<\/p>\n<p>According to the statements given by PNB officers and PNB OIC Buddhika Balachandra at the magisterial inquiry, the narcotics team, on a tip-off had raided the night club to arrest an \u2018ecstasy\u2019 dealer who was said to have been trafficking in the drug at the hotel. When the PNB officers who were in plain clothes were leaving the night club after completing the 10-minute raid, Malaka had obstructed them and abused them in foul language. Malaka had allegedly threatened the police officer at gunpoint and assaulted the police officers. Later he had called his bodyguard who was armed with a pistol and attacked the police officers.<\/p>\n<p>The PNB team had allegedly withdrawn from the place as the accused were armed and as they did not want to create a problem there. Later they had complained to the Colombo Fort police station.<\/p>\n<p>The accused had later surrendered to the police station. Ironically two days after the attack former IGP, Chandra Fernando, released Malaka and the thugs claiming that there were no evidence against the three.<\/p>\n<p>On September 2007, although over a dozen people, including the staff of the Bistro Latino night club has seen the brutal attack on Chaminda Senasinghe by Malaka, neither the staff nor the visitors came forward to implicate Malaka, who had figured in a series of brawls in night clubs.<\/p>\n<p>Senasinghe was head butted and said to be hit with a gun by the unruly ministerial brat, involving a female German national Chaminda was dining with.<\/p>\n<p>Although it is a criminal offence, the police took it in light vein disregarding the right of the victim. Malaka was earlier subjected to a suspended imprisonment for a similar offence. The police said that Malaka cannot be arrested on a complaint and produced in courts.<\/p>\n<p>On another incident, both father and son ran amok and destroyed property at another Colombo night club in 2004. On that occasion, Junior Silva got into a fight at Clancy\u2019s night club and Senior came along with his goons for support. Before long, severe damage was caused to the Clancy\u2019s night club and the Soprano\u2019s Karaoke Bar in the same building. A security guard who witnessed the whole incident had told police that it was Mervyn Silva, along with his goons, who had damaged the property of the club. However, a few days later, the security guard had changed his story, presumably under political pressure and gave an affidavit retracting his earlier statement to police. The courts, meanwhile, dismissed the case for the lack of evidence.<\/p>\n<p>It was not so long ago that Public Relations and Public Affairs Minister, Mervyn Silva\u2019s son, Malaka Silva, and former Minister, Mano Wijeratne\u2019s son Rehan Wijeratne, assaulted an Army Intelligence Officer at Jaic Hilton.<\/p>\n<p>The army officer who was beaten by the minister\u2019s son and MSD personnel was later admitted to the Accident Ward of the Colombo National Hospital. An army corporal who was with the Army Intelligence Officer at the time of the incident too came under attack by these ministerial offspring and the MSD personnel. Malaka Silva was accused of taking the service firearm and the mobile phone of Major Chandana Pradeep.<\/p>\n<p>Malaka is notorious for his terrorizing behaviour, especially in nightclubs, and the case was swept under the carpet claiming that it was the fault of Major Chandana Pradeep.<\/p>\n<p>Due to alleged presidential patronage, Malaka has committed many crimes over the years and no action has been taken on any occasion against him.<br \/>\n<em><br \/>\n********************************************<\/em><\/p>\n<p><strong>    Other Ministerial offspring<\/strong><\/p>\n<p>    It was the same with the case of the sons of Ministers, S.B. Dissanayake and Mahinda Wijesekera at a Colombo nightclub.<\/p>\n<p>    Pavitra Fernando, son of the then Airport and Aviation Services Limited, Chairman, Hemasiri Fernando, was attacked by the sons of Ministers S. B. Dissanayake and Wijesekera at a nightclub at Hotel Oberoi.<\/p>\n<p>    There again the police tried to cover up the incident by disallowing Fernando to lodge his complaint at the Kollupitiya Police.<\/p>\n<p>    It was the same with Lohan and Chanuka Ratwatte. Although they were wanted in connection with the mass murders in Udatalawinna where 10 Muslims were massacred allegedly by servicemen who were providing security to Anuruddha Ratwatte, the police deliberately failed to arrest the two brothers.<\/p>\n<p>    Amongst the ministerial offspring that have misbehaved and acted unruly manner is Ramith Rambukwella, son of Media Minister and Cabinet Spokesman Keheliya Rambukwella. He has not only brought humiliation to the country but also to the gentleman\u2019s game with his unruly behaviour on board British Airways flight 2158 from St. Lucia to London\u2019s Gatwick airport by trying to open the exit door under the influence of liquor.<\/p>\n<p>    Most of the Royal College tutorial staff members were unhappy with Principal Upali Gunasekera for not taking any action against Ramith on many occasions. However Principal Gunasekera cannot be blamed as he was under tremendous pressure from Minister Rambukwella and his wife on many occasions when Ramith was caught for misdeeds as a Royal College student.<\/p>\n<p>    Health Minister, Maithripala Sirisena\u2019s son, Daham Sirisena, in February 2013 attacked DIG Ravi Waidyalankara\u2019s son Asela Waidyalankara on the Pasikudha beach taking law unto his hands. When two police officers who were patrolling on the beach tried to settle the fight, Junior Sirisena and his security guards-MSD have assaulted the two police officers as well. It was surprising how the then Police Spokesperson, SP Buddhika Siriwardena, tried to cover up the whole incident and was careful not to tell the media that two of their own officers Sgt K. Kulasekeran and PC Wickremaarachchi of Vakarai Police, who were sent on special duty to the Kalkudha Police during the long weekend, too came under attack from Daham Sirisena and the MSD officers<\/p>\n<p>    Although SP Siriwardena, denied that two police officers got injured at the brawl and was admitted to the Valachchanai Base Hospital, reliable Kalkudha Police sources confirmed to The Sunday Leader that Sgt K. Kulasekeran and PC Wickremarachchi were admitted to Valachchanai Base Hospital for sustaining injuries.<\/p>\n<p> <em>   ******************************************<\/em><\/p>\n<p>  <strong>  Misuse of MSD officers<\/strong><\/p>\n<p>    The alleged misuse of MSD officers by children of ministers is strictly against the ruling served with a circular.<\/p>\n<p>    The MSD officers cannot go beyond their line of duty which we remind them of at every meeting. Their sole duty is to protect the minister and no one else as there are no threats to the lives of others other than for ministers if any. Unless they comply with the rules and regulations, we warn them that strict disciplinary action will be taken if found guilty of illegal actions while accompanying ministerial offspring.<\/p>\n<p>    Even though we warn these officers, still there are times they have had to carry out various odd-jobs on the instructions of the ministers or any other family members.
