Jayalalithaa<\/p><\/div>\n<p>For Tamil Nadu Chief Minister Jayalalithaa, many of her political crises have emanated from legal tangles. After having decimated the opposition in the Lok Sabha elections earlier in May, she faces her biggest challenge not from political rivals, but a Special Court in Bangalore that will deliver its judgment on an 18-year-old \u2018disproportionate assets\u2019 case on Saturday.<\/p>\n<p>With the Supreme Court, on Friday, declining to defer pronouncement of the verdict by the trial court, Saturday will decide whether Ms. Jayalalithaa will continue as Chief Minister or face immediate disqualification as Member of the Legislative Assembly in the event of her conviction under the Prevention of Corruption Act. Acquittal, on the other hand, may set off massive celebrations by the ruling party as she has long been claiming that the case was based on rival DMK\u2019s political vendetta.<br \/>\n<!--more--><br \/>\nElected representatives no longer enjoy protection from disqualification following a Supreme Court ruling last year that struck down Section 8(4) of the Representation of the People Act, which allowed sitting members to continue as legislators if they filed an appeal within three months.<\/p>\n<p>This is not the first time Ms. Jayalalithaa is dealing with the prospect of having to demit office after a court verdict.<\/p>\n<p>In September 2001, the Supreme Court quashed her appointment as chief minister on the grounds that a person convicted for a criminal offence and sentenced to imprisonment for not less than two years cannot be Chief Minister.<\/p>\n<p>The case against her is that she acquired wealth worth Rs. 66.65 crore during her stint as Chief Minister between 1991 and 1996, and that she was abetted in this by her aide Ms. Sasikala and two of her relatives, V.N. Sudhakaran (Ms. Jayalalithaa\u2019s former foster son) and J. Ilavarasi. The defence has argued that there was no evidence to show that three of them were \u2018benamis\u2019 of Ms. Jayalalithaa and that all four have accounted for their assets through legitimate means.<\/p>\n<p>Without a strong second line leadership, the AIADMK does not have any obvious successor to Ms. Jayalalithaa in the event of her disqualification.<\/p>\n<p>As in 2001-02, when O. Paneerselvam was the chief minister replacing her, Ms. Jayalalithaa will remain the power behind the throne even when she is out of office as long as her party is in power.<br \/>\n<em><br \/>\n*****************************<\/em><br \/>\n<strong><br \/>\nJudge Cunha is Fifth Judge in Eleven Years  to Hear Jayalalithaa Wealth Case<\/strong><\/p>\n<p><strong> By Krishnaprasad<\/strong><\/p>\n<p> The disproportionate assets case against Tamil Nadu Chief Minister Jayalalithaa that took nearly 11 years at the Special Court in Bangalore to reach the stage of final verdict, has witnessed four full-time judges before it landed in the hands of the present judge, John Michael Cunha, who is set to deliver the verdict on Saturday.<\/p>\n<p>A.S. Pachhapure, the first judge of the Special Court, assumed the post in December 2003 after the case was transferred to Bangalore by the Supreme Court in November that year. However, he could not conduct proceedings from August 2005 as the Supreme Court had stayed the order passed by him by clubbing the two cases into one case of disproportionate assets. The post fell vacant in July 2007 when Mr. Pachhapure was elevated as a judge of the Karnataka High Court.<\/p>\n<p>Later A.T. Munoli took charge as the judge but no effective proceeding was held during his tenure due to Supreme Court\u2019s stay order. After his retirement, B.M. Mallikarjunaiah was appointed to the post.<\/p>\n<p>The trial had made substantial progress as crucial proceedings like re-examination of some of the witnesses by the prosecution, recording the statements of Ms. Jayalalithaa in person, etc were conducted during the tenure of Mr. Mallikarjunaiah, who retired in August 2012.<\/p>\n<p>M.S. Balakrishna took over the position in November 2013 and he completed the process of recording statements of three other accused and had almost completed final arguments when the controversy arose about the certain procedure adopted by him and the new Special Public Prosecutor G. Bhavani Singh. Though Supreme Court upheld the procedure and permitted to continue the service of Mr. Balakrishna beyond his retirement for completing the trial, he refused to continue after his retirement on September 30, 2013.<\/p>\n<p>Following this, Mr. Cunha was appointed to the post in October 2013 and he heard the final arguments afresh. He had passed strictures against the accused and their counsel for \u201cprotracting the trial and suppressing the facts from the Court.\u201d<\/p>\n<p>Mr. Cunha, hailing from Mangalore, had started practise as a lawyer in 1985 and was selected to the post of district judge in 2002. He served in Dharward, Bellary and Bangalore in various positions, including as Secretary to the Chief Justices and as Registrar (Vigilance) of the High Court prior to his present posting.<\/p>\n<p><em><br \/>\n***************************<\/em><\/p>\n<p><strong><br \/>\nPolice deployed in full strength in Bangalore as Crucial day Dawns for Jayalalithaa<\/strong><\/p>\n<p><strong> By  Sruthisagar Yamunan<\/strong><\/p>\n<p>The thunderous showers that brought Bangalore to its knees on Friday have failed to dampen the loyalty of AIADMK workers, with the city expected to be flooded with party members for the D-Day in the long-drawn legal battle involving Tamil Nadu Chief Minister Jayalalithaa.<\/p>\n<p>A special court here strikes the hammer of justice in her \u2018disproportionate assets\u2019 case on Saturday, the twists and turns of which have kept Tamil Nadu on tenterhooks for over 18 years.<\/p>\n<p>All eyes at the Parappana Agrahara prison complex, where the judgment is set to be pronounced, would be on the AIADMK supremo, who is expected to reach Bangalore by a special flight on Saturday morning.<\/p>\n<p>She will move by road to the court though a helipad had been kept ready to accommodate last-minute changes.<\/p>\n<p>Police forces from both Karnataka and Tamil Nadu, which have seen bitter water wars in the past, will provide unprecedented security to Ms. Jayalalithaa, who would witness a crucial moment of her political career in a State which was originally her birthplace.<\/p>\n<p>From high-ranking Ministers to ordinary workers, the AIADMK entourage accompanying Ms. Jayalalithaa may run into thousands, police sources say.<\/p>\n<p>Reflecting their diversity, there was a deluge of accommodation bookings in the city, both at five-star hotels and lesser-known lodging houses, upping the workload for the police force.<\/p>\n<p>The early birds who reached Bangalore on Friday included Higher Education Minister P. Palaniappan and Revenue Minister R.B. Udhaya Kumar.<\/p>\n<p>They did a reconnaissance of all the security arrangements made for the three-time Chief Minister even as police officers from Tamil Nadu were closeted with their counterparts in Bangalore to discuss the protection blanket.<\/p>\n<p>A source said majority of Tamil Nadu Cabinet members, MPs and several MLAs of the AIADMK were expected to make their way into Bangalore by Friday night.<\/p>\n<p>\u201cAll arrangements for huge celebrations in case of an acquittal had been made. Orders have been placed for large amounts of sweets and firecrackers,\u201d a party leader said.<br \/>\nSecurity<\/p>\n<p>Police sources said apart from Z-Plus category security Ms. Jayalalithaa was entitled to, over 2,000 police personnel, including two platoons of the Rapid Action Force, will be pressed for her security.<\/p>\n<p>\u201cThe route her convoy will proceed on has been sanitised completely. We have also increased patrol in areas dominated by Tamil-speaking people,\u201d a police official said.<\/p>\n<p>A Tamil Nadu police officer pointed out that an eye will be kept on Opposition party members who were in the city to ensure there were no clashes. General Secretary of the DMK, K. Anbazhagan, was an intervener in case and was instrumental in shifting it from Tamil Nadu to Karnataka in 2003.<\/p>\n<p>Anticipating trouble, the Karnataka State Road Transport Corporation has suspended bus services from Bangalore to Tamil Nadu between 6 a.m. and noon on Saturday. Numerous check-posts have also been put in inter-State border areas to monitor movement.<\/p>\n<p>The special judge hearing the trial, John Michael Cunha, is expected to deliver the all-important verdict at 11 a.m.<\/p>\n<p>Heavy security will also be provided to the other three accused in the case c\u2014 Sasikala Natarajan, V.
