Vigneswaran<\/p><\/div>\n<p>Justice C. V. Vigneswaran may have been well  known among the legal community, but until two weeks ago not many knew him, except perhaps the Sinhala nationalists.  He garnered their attention because of the harsh sentiments expressed in the speech he made at the ceremonial sitting as a new Supreme Court Judge in 2001, on extremism and against the Sinhala community.<\/p>\n<p>This  compelled legal luminary, S. L. Gunasekera, to publish a response in the mainstream newspapers.   Now,  he has become the leading newsmaker in the country, courtesy the Tamil National Alliance (TNA) naming him as their Chief Ministerial candidate for the North. Unless, there is a miracle performed or blunder committed by the government, the TNA will secure victory at the Northern Provincial Council election.  Hence, the Chief Ministerial candidate of the TNA is essentially the Chief Minister of the North.<\/p>\n<p><!--more--><\/p>\n<p>The favoured Chief Minister candidate  among the Northerners was veteran politician Mavai Senathirajah, who reportedly knows the pulse of the people due to his longstanding engagement in grassroots politics.  However, Vigneswaran got the candidacy in my view, because of the influence of the international network of the LTTE rump and members of the international community who are against Sri Lanka.   The reason for this, I believe, is because the TNA does  not intend to use the powers of the Provincial Council for the maximum benefit of the Northerners.  If the welfare of the Northerners was the case, the Alliance  would have chosen Senathirajah.<\/p>\n<p>Following the military defeat of the LTTE in Sri Lanka, members of the international Tamil network have become increasingly active in pursuing their goal, which is a separate state in Sri Lanka for Tamils.  To this end, they established the Government of Tamil Eelam without a territory following the precedents set by Yasser Arafat for Palestine and Venerable Dalai Lama for Tibet.  They elected the government having elections in 16 countries.  V. Rudrakumaran, the former legal adviser of the LTTE, was elected as the Prime Minister of the so called government.<\/p>\n<p><strong>Tamil separatism still in action<\/strong><\/p>\n<p>Although the LTTE was defeated militarily in 2009, Tamil separatism is still in action in a different form.  The TNA, which functioned as the political wing of the LTTE, gives the leadership to this new form of separatism. This was indicated by  TNA Leader, R. Sampanthan, who in his speech at the 14th conference of the Illankai Tamil Arasu Kachchi (ITAK) in May 2012,  maintained they had not given up the goal of establishing Tamil Eelam in Sri Lanka.<\/p>\n<p>The strategy of the Sampanthan-Rudrakumaran alliance is to establish the separate State through diplomatic means instead of military means, following in the footsteps of founders of Pakistan and Israel.  Therefore, they needed a person who could understand the Sinhala mindset and has the capacity to address the international community,  instead of a person who understands the pulse of  the Tamil people.  Justice Vigneswaran fits this description well.<\/p>\n<p>According to the protocol of precedence of the government, the rank of a Supreme Court Judge is on par with that of a Cabinet Ministers.  In this context, Justice Vigneswaran is the only anti-Sinhala, anti-government Tamil to reach ministerial status.  (Although there were even Tamil Chief Justices in the past, they have never expressed anti-Sinhala sentiments).  Further, he is quite familiar with the Sinhala mindset,  as he studied at  the trilingual Royal College and lives in Colombo.<\/p>\n<p>In addition to Justice Vigneswaran\u2019s familiarity with the Sinhala mindset, I believe his in-depth knowledge of law and politics, fluency in English and impressive articulation ability are all  essential ingredients for the diplomatic war for a separate state.  In light of  the above, choosing Vigneswaran as the chief ministerial candidate, I believe is an exposure of the ulterior motive of the TNA, which is to use the Northern Provincial Council for its diplomatic offensive for a separate State.<\/p>\n<p>The first Chief Minister of the merged North and East, Vardharaja Perumal, committed political suicide by forming a military force under the tag, \u2018Civilian Volunteer Force\u2019 and declaring unilateral independence.  His shortsighted action marked the end of the Provincial Council. I do not expect Justice Vigneswaran to repeat the same mistake.  He knows very well that if he attempts to misuse the powers vested in the Provincial Councils, the present government has the political capacity and the parliamentary majority to even abolish the Provincial Council System.  Hence, he will act cautiously and patiently with a view to cohabitate with the government, while awaiting the right opportunity.<\/p>\n<p>In this backdrop, the entire society will laugh at Sinhala nationalists claiming they had seen crocodiles in the tea cup.  The government may praise the Council in international fora.  However, this cohabitation is not likely to last long and will only survive until the UPFA  loses its popularity in the Sinhala community<\/p>\n<p><strong>Govt\u2019s post war popularity<\/strong><\/p>\n<p>The present government became strong as a result of its immense popularity among the majority Sinhala community,  primarily due to the  military victory.  It will fade away with time and Sinhala voters will become equally divided between two major political parties as in the past, making minority leaders the kingmakers once again.  If the Northern Provincial Council uses its powers towards establishing a separate State at that time, the government will be helpless, as it will be depending on the minorities for its survival.<\/p>\n<p>In the recent past, we faced a war waged by the terrorist able to secure the  sympathy and tacit support of the western community.  In light of the above situation, it will be a nightmare, if the provincial administration decides to form a military force under the cover of police powers vested in the Council, following in the footsteps of Vardharajah Perumal.<\/p>\n<p>The war will then take place between two legal forces of the nation, namely, the Army and the police force, instead of having battles between the legal forces and terrorists.  In such a scenario, the western community will come forward to openly support the military separatists without any hesitation. This situation provides the opportunity for countries such as India and Norway to openly provided military support to the separatists,  shedding the guise of supporting a terrorist group.  In other words, the war would commence again,  making the sacrifice of nearly 27,000 war heroes futile.<\/p>\n<p>We have only one hope.  That is Justice Vigneswaran.  He is a novice in politics.  He has displayed his frankness and openness instead of flexibility and tactfulness during the last two weeks.  Because of his high profile judicial background, he would be reluctant to listen to other experienced but low profile political colleagues.<\/p>\n<p>Hence, he will be stubborn and frank.  I am seeing another General Sarath Fonseka in him who failed to be a political animal.  If Vigneswaran follows the footsteps of Perumal, he will give golden opportunities for the government to repeal certain powers vested with the provincial councils.
