The Court of Appeal, yesterday, said that the retired Supreme Court Judge and former Chief Minister of the Northern Provincial Council C.V. Wigneswaran had violated the Provincial Council Law, when he removed Provincial Council Minister Balasubramaniam Denishwaran from his post.
Complainant Denishwaran has said in his writ application that the chief minister refused to re-instate him, in the post of Provincial Council Minister despite a court order.
The contention of Denishwaran was that only the Governor of the Province had the power to remove a minister.
Counsel Suren Fernando appeared for Denishwaran. K. Kanag Ishwaran P.C. appeared for C.V. Wigneswaran.
The Court of Appeal ordered Wigneswaran to pay the costs of the case to Denishwaran.
The Bench comprised Justice Mahinda Samarawardena and Justice Priyantha Fernando.
